Just over a week ago, a Federal Court judge ruled that two-year-old Queenslander Tharunicaa was denied “procedural fairness” when immigration officials refused to consider a request to allow her to seek safety in Australia - where she was born.

Tharunicaa and her family are still trapped on Christmas Island.

Because the Federal Court found in favour of Tharunicaa, yesterday the government was ordered to pay $206,000 in legal costs.

The awarding of costs to one party is a normal part of the legal process after the court makes a decision. It doesn’t mean that our beautiful family have been compensated for being snatched from their Bilolea home and detained by immigration officials for over two years.

But it does mean that our family can consider further legal options, because this isn’t over.

Neither last Friday's "win" nor yesterday's news means this family is any closer to coming home to Bilo. But now, they’ll have continued access to skilled legal representation if the government chooses to appeal the court’s decision.

I’m so grateful to our beautiful family’s incredible legal team, who have fought long and hard for this family and discounted their fees wherever possible.

I also need to thank every last one of you who has chipped-in to our emergency fund over the last eight months. This successful legal action taken on behalf of our beautiful family has been 100% funded by your donations.

The untold suffering this family have endured after they were snatched from their Biloela could have been avoided if the politicians had taken a fair, common-sense approach to begin with.

But right now, our Ministers have the perfect opportunity to pick up their pen and use their power to bring this family safely home to Biloela, where they can live quietly and without fuss.
