The NDP has announced they plan to cap pain and suffering damages at $5,500 for injuries ICBC WILL DEFINE AS MINOR. This is important. The Ministry of Attorney General news release states: "ICBC will develop a clear, legal definition of what constitutes a minor injury in British Columbia". Can you trust ICBC to develop a "fair" definition of a minor injury? The NDP also plans to restrict an injured victim's right to have their case heard by an independent court. In order to have rights to go to court, the victims must appear before a bureaucratic tribunal and prove that their injuries are "not minor" . We think the bad driver who caused the accident should be the one who has to face a government tribunal, not the victim.
