Sadly, at yesterday's July 20th Meeting, the Village BZA voted to approve the permit application for the developer and Leeds Pond lost the battle for now ...
But the outcome of this war depends on you and your efforts!
The BZA voted to approve the excessive 300 cubic yards of landfill and made the outrageous decision to allow the developer yet an additional 50 cubic yards (as a bonus?) for a total of 350 cubic yards ... without the developer even requesting it.
No public comment was permitted and all attempts to do so were blocked.
The shocking images showing the reality of runoff from recent storms flowing into Leeds Pond [silt seen here] were barred from consideration and the official record. Ample expert testimony and evidence that such runoff and stormwater contains pollutants was provided to the BZA and even in the Village Code Findings of Fact. The BZA ignored all of this!
One neighbor courageously attempted to speak up, but was shut down. He asserts that he pays $1,000 every rainfall for clean-up of the developer's silt that goes onto his property.
Off the record the Village officials attempted to convince this neighbor that all issues would be resolved but they have no knowledge of the actual locations of the drainage issues, have not visited the location of the flooding or have any viable solutions to prevent more flooding.
In addition to the visible runoff, the BZA also completely failed to consider the additional invisible below surface pollution that percolates through the dirt plateau at 1362 Plandome Rd. and goes into Leeds Pond. The developer failed to provide any proof or scientific evidence of the safety of the fill and the BZA admitted they did NOT have the scientific qualifications to make determinations.
The developer and new owners of 1362 Plandome Rd. did NOT even show up at the BZA meeting because it seems the result of last night's meeting was already known well in advance.
