On February 24, 2026, the Delta County Attorney filed an expedited request for an official Attorney General Opinion (RQ-0634-KP). This request asks a single, critical question: Do Texas counties have the legal authority to hit the "pause" button on industrial solar and battery storage (BESS) projects?
Why this matters for us:
The AG’s decision on this case will set the precedent for Nacogdoches County. If the AG confirms that counties have this authority, it gives our Commissioners the legal "green light" to enact the moratoriums we’ve been demanding to protect our timberland, our water, and our safety.
