Long awaited result on our case has finally come out. Yes. NGT has disposed of our case and given important judgement. moEF & CC on 14th March, 2017 issued a notification stating that within 6 months from the date of the notification the case of violators who have not taken prior Environment Clearance could be dealt with by moEF & CC. But, NGT said moEF notification has no element of retrospectively. Furthermore no provision of the notification mandates that the application actually pending and being dealt with by SEIAA should be or deemed to be transferred to moEF & CC for consideration. So, NGT directed SEIAA to consider our project EC application which was delisted in 2014 and instructed SEIAA to pass appropriate orders in accordance with law. NGT asked SEIAA to deal with our project environmental clearance application expeditiously. We have almost won the battle. But, SEIAA is yet to grant environmental clearance. Let us hope and pray SEIAA will grant post facto environmental clearance without further delay to protect homebuyers from further project delay.
