We demand the immediate resignation of any and all Mount Pleasant Community Development Authority members who vote to impose condemnation through "blight" against property owners in the Foxconn zone. 

Background:

The Village of Mount Pleasant Community Development Authority and Village Officials have stated their intent to acquire land for the Foxconn development project through eminent domain by designating property "blighted."

This attempt by the Village to use eminent domain through "blight" to acquire land for Foxconn instead of entering into fair and reasonable negotiations with property owners is improper and illegal.

Mr. Richardson, and the Village of Mount Pleasant Community Development Authority has been repeatedly notified by residents and their attorneys these actions are illegal and actions to "blight" will be challenged in a court of law.  

Wisconsin State Statute 32.03(6)  - When condemnation not to be exercised.

Property that consists of only one dwelling unit is not blighted property unless, in addition, at least one of the following applies:

1. The property is not occupied by the owner of the property, his or her spouse, or an individual related to the owner by blood, marriage, or adoption within the 4th degree of kinship under s. 990.001 (16).

2. The crime rate in, on, or adjacent to the property is at least 3 times the crime rate in the remainder of the municipality in which the property is located.

Further, property that is not blighted property may not be acquired by condemnation by an entity authorized to condemn property under s. 32.02 (1) or (11) if the condemnor intends to convey or lease the acquired property to a private entity. 

Mr. Richardson and the Mount Pleasant Community Development Authority are knowingly acting to impose condemnation through "blight" against properties that do not fit the legal definition.

Village of Mount Pleasant Code of Ordinances - Article III, Code of Ethics on Misconduct in Office.

Public officials (including appointed committee and commission members) and employees are prohibited from: 

Performing an act knowingly in excess of their lawful authority or one in which they know they are forbidden by law to do in their official capacity.

Any member of the Mount Pleasant Community Development Authority who casts a vote to impose condemnation through "blight" against property owners in the Foxconn zone - does so knowing they are violating state law and therefore is called upon by the following community members to immediately resign from service on the Village CDA.
