Recently, the National 
Medical Commission (NMC) has faced legal setbacks in India. One prominent case occurred in September 2024, when the Supreme Court dismissed the NMC's appeal against a Kerala High Court ruling related to increasing medical seats at KMCT Medical College. The court criticized the NMC for acting unfairly and imposed a ₹10 lakh fine for causing unnecessary litigation. The NMC had initially approved the increase in seats, but later withdrew its decision, forcing the college to pursue legal remedies. The Supreme Court found this to be harassment and an abuse of legal process.

Such cases highlight ongoing scrutiny of NMC's decisions, particularly in the realm of medical education regulations.

Prima facie,they found that the attitude of the NMC is not of a model litigant. The NMC is an organ of the State and is expected to act in a fair and reasonable manner,” the bench said in its order passed on September 9.
