The Issue

In 2022, I embarked on a journey to obtain my personal medical files from Mt. Hope Hospital, only to face a barrage of denial rooted in institutional evasion. These files are not just records—they contain critical evidence of suspected medical negligence. This withholding by the institution isn’t just an inconvenience; it represents a severe conflict of interest when public authorities are left to police themselves.

The Freedom of Information Act (FOIA) in Trinidad and Tobago was designed to provide transparency and accountability by allowing citizens to access information from public authorities. However, when an FOIA request is managed internally by the very institutions implicated, this undermines the purpose of the Act and erodes public trust. This is especially concerning in cases involving alleged negligence or wrongdoing.

Consider the implications when a public authority can selectively release or withhold information that may document their own failings. This framework creates an environment where accountability is compromised, and ordinary citizens like myself are left without recourse. When public institutions operate without external oversight, transparency is diminished, and justice delayed becomes justice denied.

To address this systemic issue, we must advocate for a revamped FOIA process that includes:

1. **Independent Oversight:** Implementing a neutral, independent body to oversee FOIA requests, ensuring that transparency is applied uniformly and without bias.

2. **Automatic Reviews:** Establishing automatic review mechanisms for cases potentially involving significant public interest or allegations of misconduct.

3. **Time-bound Disclosures:** Enforcing strict timelines for the release of information, with penalties for non-compliance to deter delays.

Reforming these processes will enhance governmental accountability, giving citizens the empowerment promised by the FOIA. Such measures would ensure that individuals can access necessary information especially in matters of public health, safety, and welfare without institutional barriers.

Join me in this critical advocacy for FOIA reform in Trinidad and Tobago. It's time to demand transparency, fairness, and accountability from public institutions that serve as the custodians of our rights. We should not have to fear that institutions can hide behind bureaucracy when their actions come into question. Sign this petition to champion this change and reinforce the integrity of our public systems.
