Dear Beachwood School Board President Walsh,
I was very upset this weekend to learn that Jason Hill, a longtime and wonderful teacher, was forced out by Superintendent Bob Hardis and is no longer employed by the Beachwood schools.
I was forwarded the email thread that started with an email from Vivi and Rance Mack, to all school board members and Dr. Hardis. You replied that you could not discuss the circumstances because “Personnel matters are confidential by law.” This is not true and as the school board president, you must know this. How did Dan McIntyre, the school district’s attorney, allow the school board president to send an email claiming that “Personnel matters are confidential by law”?
The public deserves to understand the reasons behind Mr. Hill departure. Without this information there is no transparency and the public does not have the information needed to determine if they believe he was treated fairly. I will use this email address to send information once it is verified, since you have made it clear that you have no intention of doing so.
This brings me to the main point of this email as I was provided the following troubling information alleging an illegal arrangement involving Dan McIntyre that the school board president should be made aware of.
I was told that in early 2023, Mr. McIntyre wrote a $15,000 personal check to “Beachwood Citizens for Quality Schools,” the group set up to campaign for the passage of this ballot measure to build two new elementary schools, with the assurance that he would get this money back by inflating invoices for legal work spread out over a couple of months, which would not be scrutinized or challenged. I didn’t believe this but when I looked up the campaign finance report for “Beachwood Citizens for Quality Schools,” it showed that Daniel McIntyre wrote a $15,000 check on 3-10-23.
I expect you and others will feign outrage that such an accusation was made, hoping everyone will pretend they have the brain capacity of a plant, and believe it is totally above board and normal for the person the district hires to provide them legal advice, who doesn’t live in Beachwood or have children in the schools, wanted the bond issue to pass so badly that he wrote a personal check for $15,000 to fund the campaign. I voted for the May 2023 ballot issue and campaigned for it, but that doesn’t mean I think it is acceptable for the district to illegally funnel $15,000 of public dollars into the campaign to influence the outcome of an election.
What are you going to do with this information? Any competent attorney providing you with legal advice would tell you that you need to hire an independent law firm to conduct an independent investigation into this allegation without any interference from any school officials. This investigation should identify every individual made aware of this $15,000 donation, and the findings from the investigation should be published on the school district website, so there is complete transparency. The only reason why you would be against initiating an investigation like this is that you were aware of this $15,000 donation and this arrangement.
It was also suggested that this investigation should include looking into whether Mr. McIntyre’s law firm paid to take Dr. Hardis on an expensive fishing vacation, which is a gift he would have been prohibited from accepting. Someone told me that this was uncovered, and when it was, Dr. Hardis quickly repaid the expenses of that trip since it was illegal to accept such a gift from a vendor. I don’t know if this is true, but if it is, having to pay back money received illegally, only after being caught, isn’t much of a penalty, and is information the public should be aware of.
To end this email, I want to make two Freedom of Information Act requests. The first one is for all email lists the schools use to send out information. The purpose of requesting this is so I can forward this email and information to the community. The second request is for Mr. Hill’s personnel file. Despite your claim that “Personnel matters are confidential by law.”, his personnel file will contain all documents related to any imposed or alleged discipline.
Please respond to this email address and let me know if there is anything else I need to do to make these Freedom of Information Act requests.
I look forward to your prompt response and for the public announcement that a law firm was hired to conduct an independent investigation to look into the information and accusations this email contains.
