Please be advised that a statement is only defamatory if it is not true. Yes it is true that a portable DNR is completely legal, but a portable DNR is not the same as having a blank DNR pre-signed by the physician. Under North Carolina law (N.C.G.S. 90-21.17), a Do Not Resuscitate (DNR) order must be issued for a specific patient, agreed upon by the patient or their legal representative, and signed by an authorized medical provider (physician, physician assistant, or nurse practitioner). A blank, pre-signed form is invalid. In North Carolina, blank DNR (Do Not Resuscitate) forms cannot be pre-signed by a provider and kept in an office. A DNR is a binding, legal medical order that requires specific patient information, a clinical evaluation, and a verified signature by an authorized provider to be valid. Therefore, it is indeed illegal to have had those pre-signed DNRs in staff’s office according to the state that we live in. Therefore, as asked in the recent Cease and desist order I will not be removing this petition nor any update I have posted. Everything posted on this petition can be proven to be true beyond reasonable doubt therefore it is not defamatory or slander and I have the freedom of speech to petition anything and anyone for any reason. But, if I’m receiving a cease and desist order from a lawyer’s office that lets me know that progress is being made. Also please be advised that this petition is not to be malicious but to bring awareness to the ongoing systemic issues in the Landings of Swansboro that can be proven beyond reasonable doubt and we the people are calling on NCDHHS to act. I do understand how something like this could hurt one’s reputation. I encourage the NP and all involved to contact the NCDHHS and the NC board of nursing themselves to ensure their information is accurate before encouraging an attorney to contact me. Also my reason for being terminated was investigated and unfounded. That should have been included as well. The petition will not be removed and I will continue to inform all of you in updates as they are sent to me. Thank you
