On August 9th, 2023, the Case Management Justice dismissed my Application for Judicial Review filed in Ontario Divisional Court on account of my requests for an Injunction, Charter Considerations and Remedial Relief which are adjudicated in Superior Court -- hence, dismissal based on "abuse of process".

The good news is that the dismissal was not based on the "merits" of the case, which the Justice indicated may be brought before Superior Court in the form of a Notice of Application.

On August 21, 2023, RUCK v. CITY OF MISSISSAUGA, file number CV-23-00002991-0000 was registered in Superior Court with a Case Management Conference currently scheduled for January 9, 2024.  

As Emerson said, "It's not the destination, it's the journey." and that certainly applies to this Self-represented Applicant navigating the formal steps mandated in the process to bring this matter before a judge for adjudication. 

In the interim, the City of Mississauga denied repeated requests for clarification, exception and a Compliance Deadline extension pursuant to the 3rd Notice of Contravention issued on July 17th, 2023 until the matter is adjudicated in Superior Court. 

On August 14th, 2023 the signing By-law Officer with weed-whacker crew arrived unannounced to whack "all tall grass and listed weeds" over 20cm leaving Golden Rod, Milkweed, Asters, Red Clover and ornamentals "untouched". 

The soon-to-be-released sequel LAWN RAGE II - Someone's Cutting Our Grass! is a testament to what really transpired on August 14th and why the Administration and Enforcement of Mississauga's By-Law 125-2017 needs to be rescinded.
