URGENT: City Ordered Garage Open – Deadline Missed! HOA Defies Order & Threatens Collection

Dear Amazing Supporters,

Thank you for helping us surpass [insert current signature count, e.g., 1,250+] signatures – your voice is forcing change at Vietnam Town!

On December 18, 2025, San José Spotlight reported in their article "San Jose cracks down on Vietnam Town mismanagement" that the City of San Jose's Planning, Building and Code Enforcement Department ordered the Vietnam Town HOA to immediately remove barricades and dumpsters blocking our 550-space parking garage by the end of that day (Thursday). This was a direct response to merchant complaints, the ongoing lawsuit, and pressure from our petition – a huge step toward restoring customer access and saving our businesses!

But two days later, as of December 20, 2025, nothing has happened. The garage ramps remain fully blocked, and our shops are still suffering devastating losses.

Worse, the management company (Intempus Management) is now aggressively threatening unit owners with collection actions – including extra fees, interest, and legal proceedings – simply for refusing to pay unfair and disputed assessments. On December 19, Assistant Property Manager Jorge Adrian sent emails stating delinquent accounts are being "forwarded to collections." This targets owners fighting assessments that violate our CC&Rs by unfairly undercharging large tenants.

We can't let the HOA and management defy the city's order or intimidate owners standing up for fairness! Our vital community hub in Little Saigon is at stake.

We need your help to push harder:

Demand immediate enforcement of the city's order to reopen the garage under city oversight.
Call for an investigation into these collection threats as potential retaliation and breach of fiduciary duty.
Support fair assessment recalculations based on the original CC&Rs formula.
