1. De procéder à un réexamen collectif des amendes de 200 $ imposées aux associations-membres relativement à l’Assemblée générale convoquée le 22 août 2026;
2. De déterminer formellement si une réunion qui n’a pas atteint le quorum nécessaire pour « commencer une session », au sens de l’article 23, alinéa 1, des Statuts, peut néanmoins entraîner l’application de la sanction prévue pour l’absence d’une association-membre à une Assemblée générale;
3. De communiquer aux associations concernées la base statutaire et réglementaire précise justifiant, le cas échéant, l’application de l’amende lorsque la session n’a pas pu commencer faute de quorum;
4. Si aucune disposition ne prévoit clairement l’application de cette sanction dans une telle situation, de procéder au remboursement intégral des 200 $ à chacune des associations-membres ayant déjà acquitté cette amende;
5. De suspendre, pendant l’examen de la présente demande, toute procédure de recouvrement relativement aux amendes de 200 $ qui n’auraient pas encore été acquittées pour l’Assemblée générale du 22 août 2026;
6. De garantir une égalité de traitement entre toutes les associations-membres concernées, qu’elles aient déjà acquitté ou non l’amende;
7. De communiquer aux associations-membres, dans un souci de transparence, le nombre d’associations sanctionnées, le nombre d’associations ayant acquitté l’amende et le montant total perçu relativement aux sanctions découlant de la convocation du 22 août 2026;
8. De clarifier pour l’avenir, conformément aux mécanismes prévus par les Statuts et le Règlement intérieur, les conséquences de l’absence d’une association-membre lorsqu’une Assemblée générale convoquée ne peut commencer faute de quorum;

COLLECTIVE PETITION
REQUEST FOR REVIEW AND REFUND OF THE $200 FINES IMPOSED FOLLOWING THE GENERAL ASSEMBLY CONVENED ON AUGUST 22, 2026
To the attention of the President of the Board of Directors
Retour au Pays Natal (RPN)
CP 692, Montréal, Succursale B

Subject: Collective Petition Requesting the Review and Refund of the $200 Fines Imposed on Member Associations in Connection with the General Assembly Convened on August 22, 2026
Dear Mr. President,
We, the undersigned member associations and representatives, respectfully submit this petition to the Board of Directors of Retour au Pays Natal (RPN) to request a collective review and refund of the $200 fines imposed on member associations that were not represented at the General Assembly convened on August 22, 2026, which ultimately could not properly commence because the required quorum was not met.
Our initiative in no way calls into question the importance of member associations participating in General Assemblies, nor their obligation to comply with the RPN’s Statutes and Internal Regulations.
Rather, this petition seeks a determination as to whether, in the particular circumstances of August 22, 2026, the conditions required for the application of the $200 sanction were actually met, taking into account the statutory provisions governing quorum.
I. QUORUM IS EXPRESSLY REQUIRED TO COMMENCE A SESSION OF THE GENERAL ASSEMBLY
Article 19 of the Statutes provides that:
“The General Assembly is the supreme governing body of the RPN.”
Article 20 further specifies that the General Assembly is composed of member associations that are duly registered and in good standing with respect to their financial obligations, and that each member association is represented by a duly authorized delegate.
More importantly, Article 23, paragraph 1, of the Statutes expressly provides:
“The quorum required to commence a session of the Ordinary General Assembly shall be twenty-five percent (25%) of the members duly registered and in good standing with respect to their financial obligations.”
Paragraph 2 further provides for a 51% quorum for a resolution to be validly adopted during an Ordinary General Assembly.
However, in the circumstances surrounding the General Assembly convened on August 22, 2026, the quorum required to commence the session was not met, and the General Assembly was consequently cancelled.
This situation therefore raises an important question of interpretation:
When a duly convened General Assembly cannot commence because the statutory quorum has not been met, does the failure of a member association to attend that convened meeting nevertheless constitute an “absence […] from a General Assembly” automatically giving rise to the $200 fine?
II. WE ACKNOWLEDGE THE EXISTENCE OF THE $200 SANCTION
This petition is not based on an assertion that the $200 fine does not exist under the RPN’s governing rules.
On the contrary, we expressly acknowledge that the Schedule of Sanctions attached to the Internal Regulations provides:
“Absence of a member association from a General Assembly — $200 fine.”
We also acknowledge that the Internal Regulations impose upon member associations the obligation to “participate in sessions of the Ordinary and Extraordinary General Assembly.”
The issue raised by this petition therefore concerns not the existence of the sanction, but rather its applicability to the particular circumstances of August 22, 2026.
Indeed, the Schedule of Sanctions does not expressly specify what happens to the fine when the convened General Assembly cannot commence because the quorum required by the Statutes has not been met.
In our view, this lack of express guidance warrants a review of the decision.
III. THE STATUTES AND INTERNAL REGULATIONS MUST BE READ TOGETHER
The preamble to the Internal Regulations expressly provides:
“These Internal Regulations clarify and supplement the provisions of the Statutes.”
It therefore appears necessary to interpret the Schedule of Sanctions in harmony with the statutory provisions governing General Assemblies, particularly Article 23 concerning quorum.
Furthermore, Article 26 of the Statutes provides:
“The deliberations of the General Assembly shall be governed by these Statutes, the Internal Regulations, the Morin Code, the law, and any regulations governing the operation of associations in Canada.”
It therefore appears consistent with the very spirit of the RPN’s governing documents that any financial sanction be applied with due consideration to the entire applicable statutory and regulatory framework.
IV. THE ISSUE IS NOT WHETHER THE OBLIGATION TO PARTICIPATE EXISTS, BUT WHETHER A SESSION COULD ACTUALLY COMMENCE
This distinction is fundamental.
Member associations were indeed under an obligation to participate in the General Assembly.
However, the Statutes themselves establish a prerequisite for the commencement of the session: a quorum of 25% must be met.
Since this quorum was not met on August 22, 2026, the session could not commence in accordance with Article 23.
This petition therefore asks the Board of Directors to formally determine whether the sanction for an “absence […] from a General Assembly” can be applied in the same manner when the convened meeting failed to meet the statutory threshold required for the session to commence.
In the absence of a regulatory provision expressly addressing this situation, we respectfully submit that a collective, transparent, and consistent review of the sanctions is warranted.
V. EQUAL TREATMENT OF ALL MEMBER ASSOCIATIONS CONCERNED
Some member associations have already paid the $200 fine.
The fact that these associations complied with the payment request should not place them in a less favourable position than associations that may have challenged the fine or have not yet paid it.
We therefore request that any decision resulting from the review sought through this petition be applied consistently and equally to all member associations affected by the circumstances of August 22, 2026.
Should the Board of Directors conclude that the fine should not have applied in these circumstances, all associations that have already paid should receive a full refund of the amount paid.
VI. OUR REQUESTS
Accordingly, we, the undersigned member associations and representatives, respectfully request that the President and the Board of Directors of the RPN:
1. Conduct a collective review of the $200 fines imposed on member associations in connection with the General Assembly convened on August 22, 2026;
2. Formally determine whether a meeting that failed to meet the quorum required to “commence a session,” within the meaning of Article 23, paragraph 1, of the Statutes, can nevertheless give rise to the sanction prescribed for the absence of a member association from a General Assembly;
3. Provide the associations concerned with the specific statutory and regulatory basis supporting, if applicable, the imposition of the fine where the session could not commence because quorum was not met;
4. If no provision clearly provides for the application of this sanction in such circumstances, issue a full refund of the $200 to each member association that has already paid the fine;
5. Suspend, pending consideration of this request, any collection proceedings relating to the $200 fines that have not yet been paid in connection with the General Assembly of August 22, 2026;
6. Ensure equal treatment of all member associations concerned, regardless of whether they have already paid the fine;
7. In the interest of transparency, disclose to the member associations the number of associations sanctioned, the number of associations that paid the fine, and the total amount collected in sanctions arising from the General Assembly convened on August 22, 2026;
8. Clarify, for the future and in accordance with the procedures established by the Statutes and Internal Regulations, the consequences of a member association’s absence when a duly convened General Assembly cannot commence because quorum has not been met; and
9. Provide the member associations with a written and reasoned response to this petition.
VII. A CONSTRUCTIVE APPROACH IN THE INTEREST OF THE RPN
Dear Mr. President,
This petition is not intended as a confrontational measure.
It reflects our desire to contribute to a strong, transparent organization that respects its own governing rules.
We recognize that member associations have obligations toward the RPN. At the same time, we believe that the imposition of a financial sanction should be capable of being clearly explained and justified by reference to the Statutes and Internal Regulations.
Compliance with the rules must be reciprocal: members must comply with the organization’s rules, and decisions affecting those members must themselves comply with the rules that the organization has established.
It is in this spirit of responsibility, transparency, fairness, and preservation of cohesion among member associations that we respectfully request that the Board of Directors review the sanctions imposed following the General Assembly convened on August 22, 2026.
We thank you for your consideration of this petition and remain available for any discussion that may assist in reaching a resolution consistent with the Statutes, the Internal Regulations, and the collective interests of the RPN.
Please accept, Mr. President, the assurances of our highest consideration.

1. De procéder à un réexamen collectif des amendes de 200 $ imposées aux associations-membres relativement à l’Assemblée générale convoquée le 22 août 2026;

5. De suspendre, pendant l’examen de la présente demande, toute procédure de recouvrement relativement aux amendes de 200 $ qui n’auraient pas encore été acquittées pour l’Assemblée générale du 22 août 2026;
6. De garantir une égalité de traitement entre toutes les associations-membres concernées, qu’elles aient déjà acquitté ou non l’amende;
7. De communiquer aux associations-membres, dans un souci de transparence, le nombre d’associations sanctionnées, le nombre d’associations ayant acquitté l’amende et le montant total perçu relativement aux sanctions découlant de la convocation du 22 août 2026;
8. De clarifier pour l’avenir, conformément aux mécanismes prévus par les Statuts et le Règlement intérieur, les conséquences de l’absence d’une association-membre lorsqu’une Assemblée générale convoquée ne peut commencer faute de quorum;

1. Conduct a collective review of the $200 fines imposed on member associations in connection with the General Assembly convened on August 22, 2026;
2. Formally determine whether a meeting that failed to meet the quorum required to “commence a session,” within the meaning of Article 23, paragraph 1, of the Statutes, can nevertheless give rise to the sanction prescribed for the absence of a member association from a General Assembly;
3. Provide the associations concerned with the specific statutory and regulatory basis supporting, if applicable, the imposition of the fine where the session could not commence because quorum was not met;
4. If no provision clearly provides for the application of this sanction in such circumstances, issue a full refund of the $200 to each member association that has already paid the fine;
5. Suspend, pending consideration of this request, any collection proceedings relating to the $200 fines that have not yet been paid in connection with the General Assembly of August 22, 2026;
6. Ensure equal treatment of all member associations concerned, regardless of whether they have already paid the fine;
7. In the interest of transparency, disclose to the member associations the number of associations sanctioned, the number of associations that paid the fine, and the total amount collected in sanctions arising from the General Assembly convened on August 22, 2026;
