Back on 2 May 2016, the Senate moved the motion that a representative for the Minister for Sport (Senator Nash) supply by Friday, 6 May 2016, a copy of the following documents to the Senate:
(a) the final report by ASADA investigator, Mr Aaron Walker, into the Essendon Football Club’s 2012 player supplements program;
(b) the independent review of Operation Cobia, conducted by former judge of the Federal Court of Australia Mr Garry Downes;
(c) the report of the independent review of ASADA, commissioned by the former Minister for Sport Ms Ellis;
(d) the full decision of the Australian Football League (AFL) Anti-Doping Tribunal, signed by chairman Mr David Jones, Mr John Nixon and Mr Wayne Henwood which cleared 34 Essendon footballers;
(e) the report to ASADA management by ASADA investigators reportedly detailed a strong case against Gold Coast Suns footballer Mr Nathan Bock and high performance manager Mr Dean Robinson over the use of banned peptide CJC–1295;
(f) all documentation of ASADA, the Minister or her department that relates to ASADA’s subsequent decision not to pursue anti-doping rule violations against Mr Bock and Mr Robinson
(g) all documentation of ASADA, the Minister or her department that relates to ASADA’s decision to reopen its investigation into former AFL footballer, Mr Bock.
The government failed to comply with this motion.
Mr Sinclair Davidson, a Professor of Institutional Economics in the School of Economics, Finance and Marketing at RMIT University, and a Senior Research Fellow at the Institute of Public Affairs wrote the following:
"....apparently ASADA is not subject to control by the executive government or the parliament".
"Most astonishing of all is that neither the government or its agency would be able to tabled redacted documents.

....watch Senator Fiona Nash make some startling revelations:
- The documents are not held by her department, they are held by ASADA…….as if ASADA itself were not part of the minister’s office or portfolio.
- The release of the documents to the Parliament compromises the rights of athletes…...yet someone being the victim of a star chamber doesn’t.
- The documents relate to matters that are yet to finalised – finalised by whom? ASADA did not exercise its right to appeal – from their perspective the matter is finalised.
- These are matters before the courts. No – that is a false statement. -
- The AFL Tribunal is not a court. The CAS is not a court. The matter before the Swiss courts is a technical question of process around CAS, it does not go to the demerits of the ASADA/WADA star chamber / show trial.
- The Minister of Sport cannot direct ASADA to produce documents. ……..Yep, not just out of control, but subject to no control.
ASADA cannot voluntarily comply with a request to produce documents………. Unlike their victims.
- Complying with the parliamentary order will prejudice ongoing law enforcement activity………….. That sounds like rubbish – any order of the parliament can be defied on these grounds.
- The identity of dobbers would be compromised.
The government and ASADA then claimed to be acting on “preliminary advice” yet was unable to publish even that advice.
If the Senate were serious they’d hold the ASADA CEO in contempt until the documents were produced – at the very least they’d refuse to fund the agency until the documents were released…...”.
So, is ASADA not accountable to the Australian Parliament?
What could be hiding amongst these ASADA documents?
