The father of former Essendon coach James Hird has described anti-doping chief Ben McDevitt as a "hypocrite" and says the decision to not allow the release of secret documents relating to the supplements saga as "disingenuous".
"It was disingenuous of Mr McDevitt to claim he had independent advice from the Australian Government Solicitor that he could not release the documents," Allan Hird told Fairfax Media.
"ASADA, in this instance, would be the client of the AGS. Hardly independent advice. And ASADA would have been able to frame the questions it asked to get the answers it wanted".
"I know how it works, having sought advice from the AGS a number of times during my time in the Australian public service."
"Senator Nash, the minister at the table at estimates, asserted the government had no power to intervene. Sections 24 & 75 of the ASADA Act give the responsible minister, Sussan Ley, ample scope to direct ASADA. It appears as I have discovered in dealing with ASADA and Sussan Ley, it would have been prudent for Senator Nash not to rely on ASADA or Sussan Ley for advice,"
"Mr McDevitt ran the line he was concerned about the privacy of individuals and this had influenced his decision not to release the documents. What a hypocrite. ASADA was content in 2013 to have constant leaks from its joint AFL investigation appear in the media. And it didn't mind CAS [Court of Arbitration for Sport] publishing the names of the 34 players on its website when WADA decided to appeal the AFL tribunal's decision".
"You could use the Lindy Chamberlain analogy – it will keep going until there is justice".
