Sports Lawyer Allistar Twigg from Snedden Hall & Gallop Lawyers writes:
"It is a fundamental tenet of justice that a decision-maker must be fair, and be seen to be fair. Failure to do so may constitute a breach of the rules of natural justice.
It is arguable that the CAS has breached the rules of natural justice in making the Essendon 34 decision because it was not independent in making that decision.
Accordingly, the decision can be said to be in conflict with the public policy of Australia and should be set aside by an Australian court".
