SEPA board notice violation

To the King County SEPA Responsible Official and Project Manager,
This letter serves as a formal procedural objection to the ongoing environmental and land-use review process for the proposed Petrovitsky Park Disc Golf Course. I am writing to formally request that the current public comment period be immediately frozen and extended due to a critical failure by the applicant/county to comply with King County public notice and posting regulations.
1. The Violation: Failure to Post Notice at Primary Access Points. King County code mandates that land-use and environmental notice boards must be posted at all prominent public access points, developed trailheads, and property boundaries to ensure the affected community is reasonably informed.
Currently, physical notice boards have not been posted at the specific neighborhood trail access points located at the 3 trailheads.
While a sign may be present at the main vehicle entrance of Petrovitsky Park, the public routinely and primarily accesses the specific wooded acreage designated for this disc golf course construction through these secondary neighborhood trailheads. By failing to post notice boards at these critical pedestrian entry points, the county has effectively hidden the notice from the immediate neighbors and trail users who are most directly impacted by this construction.
2. Non-Compliance with Legal Standards
Visibility Mandate: King County regulations require notice boards to face outward toward the public domain and be placed at locations where they are clearly visible to the passing public.
"Reasonably Calculated" Notice: Under Washington State’s Land Use Petition Act (LUPA) and standard SEPA guidelines, public notice must be reasonably calculated to give effective notice to affected parties. Restricting signage to a distant parking lot while leaving the actual construction access points unposted fails this legal threshold.
3. Requested Remedies
Because the required "Affidavit of Posting" cannot accurately reflect visible public notice for the entirety of the affected project boundary, I request that King County Permitting take the following immediate actions:
Freeze the Review Timeline: Discontinue or pause the current SEPA public comment timeline immediately, as authorized by county rules for improper or missing signage.
Require Additional Signage: Order the immediate installation of official public notice boards at the specific neighborhood trail entrances identified above, positioned within 5 feet of the property/street line and facing the public right-of-way.
Reset the Comment Window: Restart or extend the 14-day public comment window only after these new boards have been verified and a corrected Affidavit of Posting has been filed.
Public participation is a core requirement of the SEPA process. This requirement cannot be fulfilled when the physical notices are omitted from the very trails where the project is to be built.
