Canada Pension is not a gift. It’s a mandatory, contributory pension we’re all required to pay into—drawn directly from our income to support us in retirement or disability.

But buried within Section 65(3) of the Canada Pension Plan is a devastating loophole—one that allows secret agreements to be signed behind closed doors. Through these agreements, private insurers claim the CPP Disability pensions of severely disabled Canadians. The Minister opens the door, signs the deal, then walks away. The insurer profits. The disabled person is left with nothing.

These agreements shield insurers from oversight under the Insurance Act. And who are these insurers? Corporations whose moral compass is tuned to profit, not protection. They justify the seizure of pensions as a “financial incentive” to encourage disabled people back to work—to prevent “malingering.”

As someone living with a severe brain injury, I can tell you: this feels like cruel and unusual punishment.

I am penalized. I lose the pension I earned.
The insurer profits from my suffering.

We need to expose the harm caused by Section 65(3). We need to demand transparency, oversight, and justice.
