

Cikgu Nurhaizah's perseverance for justice CONTINUES as the 2nd High Court trial continues. She is expected to be called today as the Plaintiff's 14th witness.
Today's trial is focused on the late 2018 summons, where ex-SMK Taun Gusi student Siti Nafirah binti Siman summoned Jainal Jamran (teacher), Suid Hanapi (principal), the Kota Belud District Education Department, the Sabah State Education Department, the Ministry of Education, and the Federal Government of Malaysia.
After years of delays (due to pre-trial applications and pandemic-related Court closures), we finally reach the Plaintiff's climax today with Cikgu Nurhaizah.

Date & Time: 19 (Mon) and 20 (Tue) February 2024. On both days, trial will be 2:30pm to 5:00pm. There is no morning trial session on either day.
The Vibe: it's a formal proceeding, so silenced phones & modest attire (not necessarily formal) are required. There is a special seating area in the gallery for media & the public; the media are technically allowed the first row. There is a canteen at the Complex.

This 2018 trial has painted a shameful and explosive timeline. An abbreviated recap follows below.
From the Plaintiff:
- High Court Plaintiff Siti Nafirah stated Jainal Jamran did not enter her class nor sign the buku kawalan kelas from late Feb 2015 until the end of the school year.
- The Court was told the Defendants failed to produce the critical buku kawalan kelas for Jainal Jamran in 2015, even after the High Court demanded the record.
- Siti Nafirah shared the Defendants, including school officers, began harassing and intimidating her after her summons were filed in 2018. Further, a white van came to her home to take photographs. Siti Nafirah lodged an MACC report. There has been zero update since.
- Siti Nafirah stated Principal Suid coaxed them to write an "apology" to Jainal Jamran to return to his statutory duties. Still, Jainal Jamran did not return.
From the Defendants:
- Cikgu Erawan, a colleague English teacher at SMK Taun Gusi, stated Jainal Jamran was absent in 2015.
- Datuk Hajah Maimunah Suhaibul, then Director of the Sabah State Education Department, stated she was a family relative of Jainal Jamran, even as her department officers investigated Jainal.
- Norhana Idek, then the Ketua Bidang Bahasa at SMK Taun Gusi, stated:
- She backdated her signatures for Jainal Jamran's rancangan pelajaran harian verification record.
- Jainal Jamran had in fact not sent his rancangan pelajaran harian until August 2015.
- The school administration never monitored teachers.
- No action was taken on Jainal after an August 2015 PPD meeting.
- She was asked by the Sabah State Edu. Director (then Maimunah Suhaibul) to meet Siti Nafirah after the summons, through the school clerk.
- Abidin Marjan, a Sabah State Education Department officer, stated he scolded SMK Taun Gusi's authorities for failing to ensure teaching was conducted well. We note the Sabah State Edu. Dept. is defending this suit, alongside Jainal Jamran.
- Muarifin Mohchoeri, a Sabah State Edu. Dept. officer, stated:
- It was true Jainal's absenteeism was indeed discussed.
- There was no indication that the Kota Belud PPD had lodged reports on noncompliance of rules.
- Fadzli Rozan, a Sabah State Edu. Dept. officer, stated:
- The Sabah State Edu. Dept. knew since 2015 of Jainal's alleged absenteeism and he received a complaint regarding it.
- He stated he asked the Kota Belud PPD to investigate and that it was up to the Kota Belud PPD and / or Sabah State Edu. Dept. to refer it to the Integrity Department, if any complaint was not resolved.
- He stated he was instructed by then Sabah State Edu. Dept. Director Maimunah Suhaibul to contact Siti Nafirah after the summons were filed.
- He authorised Cikgu Nurhaizah's transfer in 2019, one year after the summon. Cikgu Nurhaizah had highlighted the absent teacher problem in 2015.
- Another English teacher colleague of Jainal Jamran (name withheld for safety reasons) stated that, after she was assigned Jainal's F4 students in her F5 class:
- Jainal's former students did not even have English exercise books.
- She was forced to cover two years' worth of syllabus in one year.
- Jainal's absenteeism negatively impacted other teachers.
- Jainal's absenteeism was an open secret at SMK Taun Gusi.
- In 2018 after the summons, Ketua Bidang Bahasa Norhana had asked this teacher for her rancangan pelajaran harian so it could be copied for Jainal who did not complete his.
- Jainal was a bad-tempered person and had 1) spit on her, 2) slam books on the table, 3) slam doors, and 4) shout in school.
