In December 2024, our small business was served with a website accessibility lawsuit despite being informed by our hosting platform that our website was approximately “99.9% compliant.”
Like many small businesses, we operate in good faith and rely on third-party providers to manage technical infrastructure and accessibility tools. We do not control underlying code or backend framework.
Last summer, our local news station interviewed us to examine the broader implications of these types of lawsuits. As the segment developed, producers began coordinating with sister stations across the country to expand coverage. It became clear that this issue extends far beyond one storefront in Orlando.
We believe in accessibility and inclusion. We also believe in fairness.
The current legal structure allows immediate litigation without a formal notice-and-cure period, meaning businesses may face significant financial consequences without first being given the opportunity to resolve potential compliance gaps.
Because of your support, this issue has gained public visibility. Our goal is simple: advocate for balanced reform that protects accessibility rights while also protecting small businesses acting in good faith.
