The John Smith Act

When criminal activity which benefits a publicly traded corporation or is direct result of company policy(ies) and criminal charges are brought a judge is to pass sentencing as if a single individual, John Smith, had committed the act. The CEO and board of directors will then each serve the sentence given to John Smith in full.

Why is this needed?

Can you really forget the mortgage fraud which lead to The Great Recession without a single CEO or board member going to prison?

Not only did these CEOs and boards of directors avoid even a hint of prison, they went off to commit other crimes.

JP Morgan Chase and Jamie Dimon committed bribery in China.

What was Jamie Dimon’s penalty? He is now advising President Trump.

Wells Fargo and CEO John Stumpf went on to open new accounts for customers without any customer knowledge or approval with gusto.

Now we have United Airlines brutally ejecting a paying customer from an airplane due to an overbooking policy brought about by corporate greed. CEO Oscar Munoz and the board of directors will not face even the threat of prison. Instead they will pay a settlement and the CEO will most likely keep his job.

Do I need to bring up BP and the Deepwater Horizon incident?

Until we the American People can hold a CEO and board of directors directly accountable for crimes of the corporation we will never change corporate culture. As long as a corporation can “just write a check” to keep their leaders out of prison they will always victimize the general population.
