This is a Mercy Petition for Muhammad Iqbal, whose first Mercy Petition was dismissed last year by Your Excellency.  The Undersigned wants Your Excellency to take a humanitarian view of this Mercy Petition. 

Brief facts of the case are relevant to be discussed that Muhammad Iqbal (death row inmate) was convicted in 1999 for a fatal shooting in Mandi Bahauddin. The District and Sessions Court of Gujranwala awarded death sentence to him regardless of being 17 years old. During trial it was surfaced that Muhammad Iqbal’s age was to be 17 years old which was determined through ossification test but the trial court in ignorance of medical test awarded death sentence.

Thereafter his subsequent Appeals to the Lahore High Court and Supreme Court were dismissed in 2002. Furthermore, his review petition had been dismissed by the Supreme Court on 28th April, 2017 on the ground that he was convicted under Section 396 of Pakistan Penal Code (PPC) which was a non compoundable offence and no compromise can be affected. M.Iqbal has been languishing in violent and notorious jail of Punjab since 1999 and has almost spent 18 years behind bars. 

He was a juvenile at the commission of an offence for which he was sentenced to death. It is also pertinent to state that Pakistan was a signatory to UN Convention on Child Rights and Juvenile Justice System Ordinance 2000 was in effect as well. Despite of mentioned laws the trial court sentenced him to death and his co accused persons were sentenced to 10 years imprisonment.
