Unqualified MLA as per Anti Defecation Act:
He voluntarily resigned to political party where from he is elected as a MLA on 15th December 2014, he will be unqualified as MLA as on as per the 10th Schedule and clause “a” in the constitution of India.
“A member of a House belonging to any political party shall be disqualified for being a member of House—
(a) if he has voluntarily given up his membership of such political party or ”
More Than Six months as a minster as a nom member of any house:
As per the constitution of India Chief Minster can appoint a non-member of any house not more than a six months. He had sworn in as minster of Telangana Government on 15th December 2014.
Article 75 (5) states that a Minister who for any period of six consecutive months is not a member of either House of Parliament shall at the expiration of that period cease to be a Minister. This supports the above-mentioned proposition that a non-Member of Parliament can also be appointed as the Prime Minister. However, such Prime Minister shall have to become a Member of Parliament before the expiry of six months period.
Article 164 (4) sates A Minister who for any period of six consecutive months is not a member of the Legislature of the State shall at the expiration of that period cease to be a Minister
From the above facts it’s failure of constitutional machinery in State of Telangana, Please can you to look into this Unconstitutional Situation and do the needful.
