UNITED STATES DISTRICT COURT
EASTERN DISTRICT OF MICHIGAN
SOUTHERN DIVISION
____________________________________________
UNITED STATES OF AMERICA,
Plaintiff,
v. Case No. 11-20551-19
JOHN GERALT,
Defendant.
_____________________________/
OPINION AND ORDER GRANTING DEFENDANT’S MOTION FOR
COMPASSIONATE RELEASE AND ESTABLISHING TERMS OF RELEASE
Pending before the court is Defendant’s Motion for Compassionate Release
Under the First Step Act. The motion has been fully briefed, and the court concludes
that a hearing is not necessary. See E.D. Mich. 7.1(f)(2). Defendant is an individual of
advanced age who suffers a wide assortment of debilitating medical conditions. Based
on the records submitted by Defendant, these conditions are chronic and show little
hope of any improvement. The Government, in response to Defendant’s motion, does
not refute the seriousness of Defendant’s medical conditions or his eligibility for release
under 18 U.S.C. § 3582(c)(1)(A). Instead, the Government opposes the motion on the
basis that Defendant’s release three years into his fifteen-year sentence would negate
the seriousness of his crimes. (ECF No. 1813, PageID.17895.)
Upon consideration of the parties’ arguments and the factors outlined in 18
U.S.C. § 3553(a), the court is persuaded that release under the First Step Act is justified
based on Defendant’s advanced age and the extraordinarily serious and chronic nature
of his medical impairments. The court will grant Defendant’s motion and order his
Case 2:11-cr-20551-RHC-MKM ECF No. 1822 filed 10/08/19 PageID.18006 Page 1 of 2immediate release. The court directed the Government to provide proposed terms for
Defendant’s release, and those terms are incorporated below. Accordingly,
IT IS ORDERED that Defendant’s Motion for Compassionate Release (ECF No.
1807) is GRANTED.
IT IS ORDERED that Defendant’s term of imprisonment is hereby reduced to the
time he has already served and that he shall be released from the custody of the
Bureau of Prisons as soon as the release plan is implemented and travel arrangements
are finalized.
IT IS FURTHER ORDERED that upon his release from custody of the Bureau of
Prisons, Defendant shall begin serving the three-year term of supervised release
previously imposed at the Greenfield Rehab and Nursing Center located at 3030
Greenfield Rd., Royal Oak, Michigan 48073, or another facility approved by the court.
