Late Wednesday evening, the developer withdrew their zoning application!
Here is how the Public Hearing went. About 80-90 people came to speak in opposition to the zoning application, including many supporters of the Monastery as well as neighbors from the Paisano Road area. However, soon after the meeting came to order, the Planning Department announced that Elmore/Brimhall had withdrawn the application late the previous night, so the item was removed the agenda. The meeting recessed for a few minutes to allow all of us to exit. We met outside with the Planning Manager, Steven Abraham, who answered questions for several minutes.
This came so suddenly, it seemed like it might be some kind of tactic to delay or avoid an outright rejection of the application. We weren't really sure of all the ramifications.
But based on the discussion with Steven Abraham, and further discussion with the Planning Department afterward, I think it's safe to say that this is a major victory!
If the developer wants to try the rezoning process again in the future, they will need to submit an entirely new application, which will take several months to prepare and process. It's unlikely they will try this approach any time soon—their application would be rejected for the same reasons.
The developer has stated they will look into their other options. It is possible for them to do some development with the current zoning. However, they will still have issues with lack of access, lack of power, and munitions polluting the area.
In the meantime, I will be filing regular requests with the county for all information on building permits, Minor Land Division applications, and other matters of public record regarding the developer's properties. I will keep this petition open for at least a few weeks to post updates on further developments.
