BREAKING: Queensland Police targeted Darren's phone data hours after a 9 news interview!!!

We are now ready to expose a major privacy breach in our case by Queensland police, an incident that raises profound, systemic concerns for every citizen across Australia.

After failing to reach an agreement with Queensland police through mediation with the Information Commissioner, our privacy breach case has now been escalated to QCAT (our third QCAT case) with a hearing scheduled for September 18th (Queensland Civil and Administrative Tribunal)

📌 FACT - Our family gave an interview on 9 News on the evening of 6th October 2022 criticising the actions of police who brutally killed our son and to set the record straight after Ian Leavers lied on national TV

📌 FACT - Early on 7th October 2022 police in Whitsundays authorised an illegal SEDNode (Secure Electronic Disclosure Node) search of Darren Gilbert’s phone dating back to 2014. This system can include call logs, texts, location, and metadata etc…

📌 FACT - A telecommunications data report was produced including a CSV spreadsheet which they would have had to check as it contained Darren’s full name, billing address, and date of birth. His identity was right in front of them from that moment.

📌 FACT - After filing a complaint in 2024 when we became aware of this privacy breach, Queensland police admitted it and apologised but they claim it was done in error, believing Darren’s phone number was Luke’s phone number.

📌 FACT - Queensland police had Luke’s phone and phone number from the day he was killed, a week before this alleged “error” occurred. The carrier was clearly visible on the home screen and the SIM card so there was no necessity to conduct any check.

📌 FACT - Queensland police now claim to not have viewed the CSV file that was attached and that the “error” was only discovered after we lodged our complaint in 2024.

📌 FACT - Queensland police allege the only information they got was the carrier of the phone number which alone serves no investigative purpose at all and could have been found by looking at Luke’s phone, if indeed that’s what the police were looking for, or by using the police internal database which does not require payment or higher authorisation.

📌 FACT - Queensland police refuse to disclose the CSV file or any other evidence relating to this illegal hack because it could prove their narrative is a lie, instead directing us to apply for RTI which we have.

Let that sink in…

• If they opened the CSV file, they knowingly spied on a public critic, the father of a fatal police shooting victim, then lied about it.
• If they didn't, they ran a deep historical trace back to 2014 without checking the data file sitting right in front of them for no investigative reason whatsoever 

The public needs to see how metadata surveillance powers are weaponised against everyday citizens who speak out 🚩
