Bring strict laws in medical negligence and for doctors doing malpractice

Bring strict laws in medical negligence and for doctors doing malpractice
The Issue
Hello I am Shreya Milind Nimonkar.
Today I would like to share my HORRIBLE experience.
I don't expect any kind of sympathy or help. This is to make you all aware of the facts and incidences happening around.
In 2010 I was having menses problem so I requested my family doctor to refer a Lady gynaecologist. He referred me to Dr Seema Shanbhag, and I started following her treatment in which she examined and advised some tests; gave medicines.I followed her treatment for 3-4 months visiting her every month after my menses.
After so long treatment, I had no positive symptoms. So Dr Seema Shanbhag again did some tests like blood ,urine etc. and advised me to remove uterus immediately as it may cause CANCER .
It was a shock for me as I was not prepared for it. I asked her if we can wait for few months as my daughter was in SSC and soon will be appearing her board exams and as I was working for a private firm I had to reserve and plan my leaves accordingly. On this gynac Dr Seema Shanbhag madam said it may be too late n regretful. She suggested the "Hysterectomy"
Laparascopy method which is costly but advanced and easy process. So Within 3-4 days I can resume my work.
Hence the surgery was planned during Diwali vacation.
I got admitted with prior recommended tests like Sonography, blood, urine, ECG,
done. Early morning I was prepared for surgery, given anesthesia and then I was unconscious for few hours.
When I was coming back to normal my husband told me that surprisingly the surgery was done by other Doctor named Dr. Ujjval Mahajan without our knowledge!
When asked about this, Dr Seema Shanbhag said she was not trained for Laparascopy and so didn't have required instruments. Therefore she called, Dr. Ujjval Mahajan, the Laparascopy Surgeon who performed it in her nursing home.
I was disappointed and helpless feeling uneasy throughout the admitted period. From the very first day of surgery I was feeling uneasy. My gynac Dr Seema Shanbhag said I will be alright once at home as this may be because of odours and hospital effects .
After discharge, I used to have a vomiting feeling, stomach pain and terrible number of burps and hiccups.
I rushed back to Dr Seema Shanbhag. She examined me and gave some medicines. This way I visited her many times, she gave some medicines, recommended some tests, gave some home remedies but my pain continued. This cycle went on for few months.
Simultaneously she referred me to
1) General physician- Dr Sandeep Patil
2) General Surgeon- Dr Prabhakar
3) Urologist- Dr Nanjappa
4) Gastroentologist- Dr Prakash Patel
According to the Urologist, Dr Nanjappa, my ureter was choked and so a surgery was planned at his hospital which was done in presence of both Dr Ujjval Mahajan and Dr Seema Shanbhag, and stents were put in both ureters.
Immediately I was moved from Dr Nanjappa's hospital to Dr Seema Shanbhag's nursing home with the catheter and urine bag with me. I was under observation for a couple of days.
Coming back home I was not having any relief from the pains.
On this I was told that a foreign part takes time to adjust in the body, so take high pain killers and consult Sr. Urologist Dr Percy Chibber at Jaslok hospital.
By this time my daughter's board exam started so I continued the painkillers for few more days.
On her last exam day I picked her from the exam center n hurried to Jaslok. Dr Percy Chibber examined me and after doing the recommended tests, said my kidneys were affected badly and an open surgery has to be done immediately.
This was again a stroke... not prepared for this one too..Looking at all phases of treatment, tests n overall expenses, we asked about the approx charges and guarantee of course! We were told that the costs may go above 5-7 lakhs depending on which stage or position it is.
We met gynac Dr Seema Shanbhag and discussed with her on which she said she will speak to the Urologist Dr Nanjappa about costs, but being a crucial surgery we had to choose among Lilavati or Hinduja hospitals, neither of which would be affordable for us.
We both passed that sleepless night thinking thinking thinking... how? where ?why?
Practically thinking, arranging money is possible but what about
Our two kids ??? Their careers, education??? If at all the surgery is failed leaving the complete family nowhere how difficult it would be for them to survive???
In morning I woke up and realised that my eyes were not opening. I stood before the mirror to find what's wrong and saw my whole body swollen .. hands, feet, neck, stomach.. every part was swollen and I got scared to death and broken. I rushed to gynac Dr Seema Shanbhag madam. She rang the Urologist Dr Nanjappa and found that he was at some seminar hence unavailable for 2 days.
I came home and broke in tears. I gave up thinking what went wrong.
After 2 days, met Dr Nanjappa . He said I have to take quick action and get admitted to some big Institute. I asked him to remove the stents thinking that may be the cause of pains. On this Dr Nanjappa said it may be a Crime now. He also wholeheartedly said if we go to Saifee hospital he can favour us Rs 5000 discount on total bill. We thanked him for the
help and again met the gynac Dr Seema Shanbhag and told her financially we are not in the position to afford and so have decided to go to Lokmanya Tilak Municipal hospital (Sion hospital). Early next morning she gave her car along with the driver to go to Sion hospital.
I hugged my both the kids and assured them I'll be back within few days. My younger son was going to appear 5th class exams.
I was not sure if I would really be back but had to pretend .
After reaching Sion hospital the head of the Dept. and Sr. urologist doctor examined me and asked me to get admitted immediately.
After a lengthy admission procces, I was admitted at a ladies ward. My husband used to stay outside the passage of ladies ward with a mattress and a newspaper to sleep. This way he continued till I was there for almost two months.
The next day a PCN was done in which 2 tubes were inserted individually in each kidney from back side with a urine bag at outer end to bypass the urine.
After one week Renal function test of individual kidney was done at Tata hospital. Then after few days they briefed my husband about the open surgery they were planning which was the only option to find out the depth of the issue.
As discussed a team of 14 doctors started with the said "Ileal surgery" was carried for around 9 hours .The Sr. Doc explained my
husband that they had cut 20cm of my intestine and attached to both ureters replacing the damaged part. Due to urine leakage my intestines were stucked up. They passed various gases in my stomach to mobilise intestine. Doctors could not close my stomach due to prolonged process of 9 hours so they just stitched the outer skin of the stomach and kept me on ventilator. They informed my husband that they will wait for 3 -4 days more.
If ever I come out safely then they will proceed with next surgery or else.......
My husband was praying to God. My kids wishing to meet us, see me, I didn't remember how long it had been.
Surprisingly with the grace of God the very next day I was normal and out of ventilator.
Doctors too were surprised and happy to see such positive results.
After a week's time a surgery was done again for about 5 hours in which my stomach was properly stitched.
With total 14 numbers of tubes all over in my body I was under observation with minute readings of each tube's outlet.
This all process was of 50 days .
All the tubes were removed and I was told by the senior urologist that it was the rarest of the rare and a very complicated surgery. Also as it's not a normal system working inside me, I have to be very careful with lifetime precaution of passing urine every 2 to 2½ hours. Then, initially weekly, then monthly and now every 4 months, I have to do all related tests like Sonography, blood, urine etc. and keep a follow up for lifelong.
Apart of physical, emotional and financial loss of my complete family, I have lost my night's sound sleep because of this.
The person responsible for all this worst situation is the gynac Dr Seema Shanbhag, who while removing my uterus, had damaged both of my ureters and inspite of knowing, didn't disclose this with us and kept experimenting.
When Dr Seema Shanbhag came to know I am going legally in this matter she came to meet me at my home and requested not to go in court.
She said" I OWE YOU MY ENTIRE LIFE..I HAVE SEEN ALL YOUR BAD PHASE I WILL GIVE YOU SOME COMPENSATION GIVE ME COUPLE OF DAYS TO THINK "
But very next day she, Dr Seema Shanbhag, called me and said. "SORRY I CAN'T GIVE YOU ANYTHING. DO WHATEVER YOU WISH TO..NO ONE CAN HARM ME. BE IT MEDICAL COUNCIL OR COURT. MIND IT! "
This has inspired me to stand up again and fight against the injustice.
I have lodged a complaint in the consumer's court and from last 4 years, fighting for justice.
As it is I have already lost and there's nothing more to loose. But sitting numb doing nothing will definitely give me more mental stress. Surprisingly when my internal case papers were demanded by my lawyer the poor gynac Madam, Dr Seema Shanbhag, replied she had lost all the documents while traveling in train. (Complaint copy was forwarded to my advocate)
I believe in God. Miracles do happen. (I am the example!) And the Sion Hospital Doctors have been so supportive and cooperative throughout.
So trust, faith and facts will help us in getting justice.
I request you all, before going to any doctors, before following any suggested or recommended tests
try to know WHY? HOW? WHAT are the importance of given treatments, WHY these tests? HOW will that be useful? WHAT is the importance of that recommend test etc etc
I have seen bad (demon) doctors and good ( angel) doctors as well.
Dear God please increase the number of angel doctors more as we common people need them and trust them most..
