The complaint 702511/2023 et al. Orrego v Morgovsky et al. is related to the following misconduct: misdiagnosis or delayed diagnosis, failure to treat, failure to refer me to Worker's Compensation providers, false and intentionally misleading statements to me, submitting false bills or claims for service, falsifying medical records or reports, lying about credentials or qualifications, unnecessary or wrong medical treatment or drug prescription, fraudulent concealment of medical records, and destruction of evidence.

Today, October 16, 2024, Judge Kevin J. Kerrigan, despite I filed plenty of evidence on the Cross Motions Seq. 010 and Seq. 011 with plenty of proof requesting an order against Defendant Democleia P. Gottesman MD and her counsel Angela Criscuolo, Peter Hays III, Jonathan Waldauer - Rubin Paterniti Gonzalez Rizzo Kaufman LLP under:
"Civil Practice Law and Rules (CPLR) § 3215, Due Process of Law, First Amendment of the US Constitution protects the right to free expression, Fourteenth Amendment Equal Protection of the Law, NYS § 240.30 Aggravated harassment in the second degree, Part Rules Professional Conduct 1200, Cost and Sanctions under Part 130 (a) (b) (c) (d), Referral for Criminal Prosecution under New York Penal Law § 210.40: Making an apparently sworn false statement in the first degree, New York Penal Law § 210.45: Making a punishable false written statement, Perjury in The First Degree Penal Law § 210.15 (Committed on or after September 1, 1967), Part 130. Costs and Sanctions, Part 1200 Rules of Professional Conduct, sanctioning a party or attorney for frivolous conduct, under 22 New York Codes, Rules, and Regulations (NYCRR) §130-1.1 (Rule 130-1.1), among others."

I filed evidence of Fraud and Perjury from Gottesman and her lawyers in March 2024 in the case of the DA Melinda Katz, Queens, NY, May 2, 2024, NYSCEF doc 358.

September 9, 2024: Transcripts Traverse Hearing and Evidence that proves the Gottesman and her counsel for Fraud on or upon the Court NYSCEF doc 349 —The transcripts of the hearing show Justice Kevin J. Kerrigan yelling at me because I filed evidence of Fraudraud because I represent my self, Hispanic, and a woman.

The record shows NYSCEF doc 349, in which Justice Kevin J. Kerrigan admits to yelling at me as he did at the previous hearing. This is an abuse of power. Instead of protecting me, Justice Kevin J. Kerrigan intimidated me.

Justice Kevin J. Kerrigan instead punishes Gottesman and her counsel; he punishes me because I filed the evidence, and he "said" he never asks for "evidence" when the parties must file the proof without the Court's request. NYSCEF Doc 361 - Evidence Gottesman's Perjury

Justice Kevin J. Kerrigan was angry but had no choice but to grant a default judgment in my favor after I filed evidence of fraud and perjury. Still, he let Gottesman and his counsel off the hook for filing false affidavits. NYSCEF doc 410 Default Judgment in my favor September 9, 2024

Justice Kevin J. Kerrigan will not punish the lawyers for all fraud and perjury because Rubin Paterniti Gonzalez Rizzo Kaufman LLP is a donor to Attorney General Letitia James, who is also dishonest. For this reason, DA Melinda Katz is ignoring my criminal complaint; see NYSCEF doc 380 Evidence of Donations to Letitia James - Open Secrets Website.

Judge J. Kevin Kerrigan is so upset with me that he is helping the Defendants and my attorneys, who want to make me pay them when I was the one harmed and injured by Gottesman's attorneys until she presented the recording of the meetings, during which the attorney Jonathan Waldauer told me that for my "own sake," I should withdraw my motion.

Justice Kevin J. Kerrigan is doing exactly what counsel Waldauer threatened me with on September 9, 2024, and said that my evidence does not matter because Judge Kerrigan will not accept it, and now he is ignoring ALL the overwhelming evidence NYSCEF doc 361

Justice Kevin J. Kerrigan has ordered me to pay fines to my abusers when the opposing party lies in court and fabricates false affidavits. I plan to appeal against these OUTRAGEOUS orders, as I believe they are a perversion of justice and morally wrong.

Justice Kevin J Kerrigan is protecting all Fraud and also blocking my right to request that my lawyers, Pasternack Tilker Ziegler Walsh Stanton & Romano LLP, and others, not comply with their obligations to give me the documentation showing all Fraudraud that Gottesman, Morgosky, and Star Medical Offices PC committed by falsifying my medical records since 2018.

I will also request that Justice Kevin J. Kerrigan recuse himself from the case. His ruling is biased and not supported by evidence, and he is aiding the defendants in lying and filing false documents.

Justice Kevin J. Kerrigan has threatened me with an order stating that if I continue to claim fraud, he will dismiss my case, regardless of the evidence supporting my claim. It seems that Judge Kevin J. Kerrigan wants to dismiss my case to prevent me from seeking justice. The Pre-trial Conference Date is scheduled for January 2025. This threat is intended to stop me from continuing to uncover the truth about the feud.

Justice Kevin J. Kerrigan should immediately vacate the order on his initiative (sua sponte) and recuse himself, as he appears compromised.

Justice Kevin J. Kerrigan has also demanded that I seek permission before filing any motion, which I believe violates my constitutional rights to due process and equal protection under the law. I am seeking to raise funds to cover the costs of the appeal, which I will file in the Appellate Division, Second Department of New York, to set a precedent against this kind of legal manipulation and corruption in the Supreme Court of Queens of New York.

I have petitioned Justice Kevin J. Kerrigan to be removed from the bench. Judges should demonstrate good temperament, courtesy, patience, level-headedness, and compassion, which promote procedural justice and respect for the laws and procedures.

The evidence in my case, NYSCEF 702511/2023, shows that Justice Kerrigan strongly supports fraud and perjury, which is unacceptable.

Please help me appeal these OUTRAGEOUS orders. Despite having evidence, we are exposed to lawfare and abuse in the legal system. In my case, Judge Kevin J. Kerrigan only threatens me to prevent me from exposing these frauds and perjury.
