We, the undersigned, demand the immediate release of Mustapha Djemali, who has been unjustly detained in Tunis since May 3, 2024, without any formal charges against him.

Who is Mustapha Djemali?

Mustapha Djemali  a Swiss citizen of dual Tunisian nationality, is the former special advisor of the UN High Commissioner for Refugees (UNHCR) and Director of the Central Asia, South Wast Asia, Middle East and North Africa Bureau, who spent his entire career with the UNHCR (from 1980 to 2004) serving the humanitarian cause.

Mustapha Djemali is not just a name. He is a father, a friend, and a relentless advocate for refugee rights. As the founder and CEO of the Tunisian Council for Refugees (CTR), he has devoted his life to aiding the most vulnerable, collaborating closely with the United Nations High Commissioner for Refugees (UNHCR) in Tunisia.

Why is he detained?

On May 3, 2024, Tunisian authorities arrested Mustapha Djemali on suspicion of CTR aiding illegal migrants by providing them with housing. However, all individuals assisted by CTR are legitimate refugees, registered and validated by the UNHCR. To this date, no formal charges have been filed against him. This detention is unjustified and unfounded.

Our concerns :

• Unjust Detention: Mustapha Djemali is imprisoned without any evidence or formal charges.

• Fragile Health: Mustapha Djemali, being elderly and fragile, is experiencing a daily deterioration of his mental and physical health in prison.

• Humanitarian Impact: His arrest jeopardizes the crucial work of the CTR, leaving numerous refugees without the assistance they desperately require.

Nous, soussignés, demandons la libération immédiate de Mustapha Djemali, détenu injustement à Tunis depuis le 3 mai 2024, sans aucune accusation formelle portée contre lui.

Qui est Mustapha Djemali ?

Mustapha Djemali, citoyen suisse de double nationalité tunisienne, est l'ancien conseiller spécial du Haut Commissaire des Nations Unies pour les Réfugiés (HCR) et directeur du Bureau de l'Asie centrale, de l'Asie du Sud-Ouest, du Moyen-Orient et de l'Afrique du Nord. Il a passé toute sa carrière au HCR, de 1980 à 2004 sur le terrain à Genève.

Mustapha Djemali n'est pas seulement un nom. Il est un père, un ami, et un défenseur infatigable des droits des réfugiés. En tant que fondateur et directeur général du Conseil Tunisien pour les Réfugiés (CTR), il a consacré sa vie à aider les plus vulnérables, en collaborant étroitement avec le Haut Commissariat des Nations Unies pour les Réfugiés (HCR) en Tunisie.

Pourquoi est-il détenu ?

Le 3 mai 2024, les autorités tunisiennes ont arrêté Mustapha Djemali, soupçonnant le CTR d'aider des migrants illégaux en leur fournissant des logements. Cependant, toutes les personnes aidées par le CTR sont des réfugiés légitimes, enregistrés et validés par le HCR. À ce jour, aucune accusation formelle n'a été déposée contre lui. Cette détention est injustifiée et infondée.

Nos préoccupations :

·       Détention Injuste : Mustapha Djemali est emprisonné sans aucune preuve ni accusation formelle.

·       Santé Fragile : Mustapha Djemali, étant âgé et fragile, voit sa santé mentale et physique se détériorer quotidiennement en prison.

·       Impact Humanitaire : Son arrestation met en péril le travail crucial du CTR, laissant de nombreux réfugiés sans l'aide dont ils ont désespérément besoin.

Ce que nous demandons :

Nous exhortons les autorités tunisiennes à :

·       Libérer immédiatement Mustapha Djemali en attendant que des accusations formelles soient établies et prouvées.

·       Respecter ses droits humains et sa dignité.

عريضة للإفراج عن مصطفى الجمالي، المدافع عن حقوق اللاجئين

نحن الموقعون أدناه، نطالب بالإفراج الفوري عن السيد مصطفى الجمالي، المعتقل ظلما بتونس منذ 3 مايو (أيار) 2024، لغاية اليوم دون توجيه أي تهم رسمية إليه

من هو مصطفى الجمالي؟

مصطفى الجمالي، مواطن سويسري يحمل الجنسية التونسية، وكان يشغل منصب المستشار الخاص للمفوضية السامية للأمم المتحدة لشؤون اللاجئين ومدير مكتب آسيا الوسطى وجنوب غرب آسيا والشرق الأوسط وشمال أفريقيا وقد أمضى كامل حياته المهنية في المفوضية منذ العام 1980 ولغاية العام 2004 في تقديم يد العون الى اللاجئين.

مصطفى الجمالي ليس مجرد اسم.. إنه أب وصديق ومدافع لا هوادة فيه عن حقوق اللاجئين حيث كرس حياته لمساعدة الفئات الأكثر ضعفًا وذلك بصفته المؤسس والمدير التنفيذي للمجلس التونسي للاجئين في تونس.

لماذا هو معتقل؟

في 3 مايو/أيار 2024، ألقت السلطات التونسية القبض على مصطفى الجمالي للاشتباه في قيامه بمساعدة المهاجرين غير الشرعيين من خلال توفير السكن لهم بيد أن جميع الأفراد الذين يساعدهم هم في الواقع لاجئون شرعيون، مسجلون ومعتمدون من قبل المفوضية السامية للأمم المتحدة والمجلس التونسي للاجئين. وحتى الآن لم يتم توجيه أي اتهامات رسمية ضده. أن هذا الاحتجاز غير مبرر ولا أساس قانوني له.

مخاوفنا:

الاحتجاز غير العادل: يُسجن مصطفى الجمالي دون أي دليل أو تهم رسمية

الوضع الصحي: مصطفى الجمالي رجل كبير في السن ويعاني من الكثير من الأمراض وصحته اخذة بالتدهور السريع في داخل المعتقل

الأثر الإنساني: يؤدي اعتقال السيد الجمالي إلى توقف وعرقلة العمل الإنساني الذي يقوم به مما يترك العديد من اللاجئين دون المساعدة التي يحتاجون إليها بشدة

ما نطلبه:

نحث السلطات التونسية على:

إطلاق سراح السيد مصطفى الجمالي فوراً أو توجيه تهم بشكل رسمي ضده وعن طريق القضاء.

. احترام حقوقه الإنسانية وكرامته وحقوقه القانونية أثناء فترة اعتقاله
