Petition for Fair Justice and the Review of Sentences Against the UÇK's Historical Leaders

On September 16, 2026, the Trial Panel of the Kosovo Specialist Chambers in The Hague announced severe sentences of 25, 18, and 13 years of imprisonment for the former leaders of the Kosovo Liberation Army (KLA): Hashim Thaçi, Kadri Veseli, Rexhep Selimi, and Jakup Krasniqi. This decision has caused a deep wave of frustration and anger among the people of Kosovo and its supporters, being perceived as a grave historical injustice.
Through this petition, we, the undersigned, wish to express our structured position and request a review of this decision, based on the following arguments:
1. The Conflict Context and Historical Inequality of Outcome It is impossible to achieve true justice without fully considering the severe context of the war in Kosovo (1998-1999). We are witnesses to a profound and systematic inequality in accountability for crimes committed in Kosovo. While countless massacres, systematic genocidal policies, the displacement of over 1 million people, the rape of over 20,000 victims, and the disappearance of thousands were committed by forces of the state of Serbia/FRY, the vast majority of the main planners of these crimes against the population of Kosovo have never been convicted or have received symbolic sentences. This creates an evident historical inequality of outcome.
2. Opposition to Sentences Perceived as Collective Punishment We consider the announced sentences to be extremely harsh given the context. In court statements, it is said: 'In the name of Kosovo... Hashim Thaçi... and the others... is sentenced.' We, the undersigned, wish to make one point extremely clear: Kosovo does not sentence its own liberators!
Some say that only individuals are being sentenced. But we feel differently. It feels as though the graves of those who fell for freedom are being sentenced. As if those who gave their lives so we can be free today are being sentenced. As if the wounds of the massacred and their very bones are being sentenced. This is not justice; it is an unequal punishment of our liberation struggle and our painful history. While the court maintains the principle of individual guilt, in the public eye in Kosovo, these high sentences against the KLA’s main leaders are inseparable from the history of the liberation struggle itself, undermining trust in the Specialist Chambers.
3. Call for Humanitarian and Procedural Review Bearing in mind this climate of perceived historical inequality and in accordance with the legal framework of the Republic of Kosovo and international law, we call upon the Court of Appeals and the President of the Kosovo Specialist Chambers. We request that the sentences be reviewed and that procedural options for human review and early release be facilitated to a measure that reflects the values of equal, impartial, and human-centered justice for all.

Më 16 shtator 2026, Trupi Gjykues i Dhomave të Specializuara në Hagë shpalli dënime drastike prej 25, 18 dhe 13 vitesh burgim për ish-krerët e Ushtrisë Çlirimtare të Kosovës (UÇK): Hashim Thaçi, Kadri Veseli, Rexhep Selimi dhe Jakup Krasniqi. Ky vendim ka shkaktuar një valë të thellë zhgënjimi dhe zemërimi në mesin e popullit të Kosovës dhe mbështetësve të saj, duke u perceptuar si një padrejtësi e rëndë historike.
Përmes këtij peticioni, ne, nënshkruesit, dëshirojmë të shprehim qëndrimin tonë të strukturuar dhe të kërkojmë një rishikim të këtij vendimi, bazuar në argumentet e mëposhtme:
1. Konteksti i Konfliktit dhe Pabarazia Historike e Rezultatit Nuk mund të bëhet fjalë për drejtësi të vërtetë pa marrë parasysh kontekstin e rëndë të luftës në Kosovë (1998-1999). Ne jemi dëshmitarë të një pabarazie të thellë dhe sistematike në llogaridhënien për krimet e kryera në Kosovë. Përderisa masakra të panumërta, politika sistematike gjenocidale, dëbimi i mbi 1 milion njerëzve, dhunimi i mbi 20,000 viktimave dhe zhdukja e mijëra të tjerëve janë kryer nga forcat e shtetit të Serbisë/RFJ-së, shumica dërrmuese e planifikuesve kryesorë të këtyre krimeve ndaj popullatës së Kosovës nuk janë dënuar kurrë, ose kanë marrë dënime simbolike. Kjo krijon një pabarazi të qartë historike të rezultatit.
2. Kundërshtimi i Dënimeve që Perceptohen si Ndëshkim Kolektiv Ne i konsiderojmë dënimet e shpallura si jashtëzakonisht të ashpra duke pasur parasysh kontekstin. Në deklaratat e gjykatës thuhet: 'Në emër të Kosovës... dënohet Hashim Thaçi...' dhe pastaj edhe të tjerët. Ne, nënshkruesit, dëshirojmë të jemi shumë të qartë: Kosova nuk i dënon çlirimtarët e vet!
Disa thonë se po dënohen vetëm individë. Por ne e ndjejmë ndryshe. Sikur po dënohen varret e atyre që ranë për liri. Sikur po dënohen ata që dhanë jetën që ne sot të jemi të lirë. Sikur po dënohen plagët e të masakruarve dhe eshtrat e tyre. Kjo nuk është drejtësi, është ndëshkim i pabarabartë i luftës sonë çlirimtare dhe i historisë sonë të dhimbshme. Sado që gjykata mban parimin e fajit individual, në syrin e publikut në Kosovë, këto dënime të larta ndaj udhëheqësve kryesorë të UÇK-së janë të pandashme nga vetë historia e luftës çlirimtare, duke minuar besimin te Dhomat e Specializuara.
3. Thirrje për Rishikim Human dhe Procedural Duke pasur parasysh këtë klimë të perceptuar të pabarazisë historike dhe në përputhje me kornizën ligjore të Republikës së Kosovës dhe të drejtën ndërkombëtare, ne i bëjmë thirrje Gjykatës së Apelit dhe Kryetares së Dhomave të Specializuara. Ne kërkojmë që dënimet të rishikohen dhe të mundësohen proceduralisht opsionet për rishikim human dhe lirim të parakohshëm, në një masë që pasqyron vlerat e drejtësisë së barabartë, të paanshme dhe humane për të gjithë.

Sikur po dënohen plagët e të masakruarve dhe eshtrat e tyre. Kjo nuk është drejtësi, është ndëshkim i pabarabartë i luftës sonë çlirimtare dhe i historisë sonë të dhimbshme. Sado që gjykata mban parimin e fajit individual, në syrin e publikut në Kosovë, këto dënime të larta ndaj udhëheqësve kryesorë të UÇK-së janë të pandashme nga vetë historia e luftës çlirimtare, duke minuar besimin te Dhomat e Specializuara.
3. Thirrje për Rishikim Human dhe Procedural Duke pasur parasysh këtë klimë të perceptuar të pabarazisë historike dhe në përputhje me kornizën ligjore të Republikës së Kosovës dhe të drejtën ndërkombëtare, ne i bëjmë thirrje Gjykatës së Apelit dhe Kryetares së Dhomave të Specializuara. Ne kërkojmë që dënimet të rishikohen dhe të mundësohen proceduralisht opsionet për rishikim human dhe lirim të parakohshëm, në një masë që pasqyron vlerat e drejtësisë së barabartë, të paanshme dhe humane për të gjithë.
