Fellow Residents, In my last update I told you that we had started a Go Fund Me page to raise money for an Eastpointe Legal defense fund. Here is the link:

As you know we submitted a legal petition on July 10th, 2024, demanding that the HOA hold a special members’ meeting within sixty (60) days to vote on and approve several amendments to the Eastpointe governing documents.  In submitting the petition we followed Fla. Stat. 720.303(2)(d), governing homeowner’s associations in Florida, and we complied with the Amended and Restated By-Laws of the Eastpointe Homeowner’s Association, state under Article II (“Members”), section 3 (“Special Meetings”) that special meetings shall be held whenever called by the President or by a majority of the Board of Directors and must be called by such officers upon receipt of a written request signed by no fewer than two hundred (200) members of the Association.”

 

The HOA President ignored our petition. We have contacted our lawyer and he submitted a letter to the HOA stating that their actions ignoring our petition violates not only Florida Statute, they violate the governing documents of Eastpointe itself. This is the first action that requires funding. If the HOA fails to schedule the special members meeting we will have to challenge these illegal actions by the HOA board in court. We will also file to void the last two Bi-Party agreements. We need your support. Once you donate, you will be provided with a detailed accounting of any funds spent for legal fees. We cannot take any actions without funding first. Please help.

 

These legal actions could easily be avoided if the HOA Board would simply allow the residents/ members to vote, as requested via our petition. Of Note, our By-laws allow for special meetings of members to be called by a vote by the majority of the Board and/or by the HOA Secretary, if requested in writing by one-third (3) of the Board. Do we not have at least 3 HOA Board members. Please contact the HOA and your village / POA Board members and tell them to “LET THE RESIDENTS VOTE”. Write to the HOA here.
