Kurzfassung
Die Nationalflagge der Eelam-Tamil:innen ist für viele Menschen ein Symbol ihrer kulturellen Identität, Sprache sowie der Verbindung zu ihrer historischen Herkunft. Sie steht in einem klaren historischen Zusammenhang mit der Geschichte der Eelam-Tamil:innen und ihren Traditionen. Wir fordern eine rechtssichere und differenzierte Bewertung dieser Flagge in Deutschland. Das Zeigen der Flagge darf nicht als strafbares Kennzeichen im Sinne des § 86a Abs. 2 S. 2 StGB behandelt werden, denn sie ist Ausdruck kultureller Identität, gemeinschaftlicher Zugehörigkeit und politischer Meinungsfreiheit.

Seit den 1990er-Jahren wird die Flagge der Eelam-Tamil:innen weltweit als Symbol kultureller Identität, Sprache und historischer Herkunft verwendet. Insbesondere bei Versammlungen, Gedenkveranstaltungen und kulturellen Anlässen hat sie sich über Jahrzehnte als identitätsstiftendes Symbol etabliert. Seit etwa 2021 ist in Deutschland zunehmend eine strafrechtliche Verfolgung beim Verwenden der Flagge im öffentlichen Raum zu beobachten. Dies führt zu großer Rechtsunsicherheit aufgrund der, unseres Erachtens nach, unrechtmäßigen Anschuldigungen im Zusammenhang mit der historisch gewachsenen Nationalflagge.

Wir fordern die sofortige Beendigung der Kriminalisierung unserer Nationalflagge und eine klare rechtliche sowie behördliche Feststellung, dass die Nationalflagge der Eelam-Tamil:innen als Ausdruck von Identität, Gedenken und Selbstbestimmung nicht nach § 86a Abs. 2 S. 2 StGB unter Strafe gestellt werden darf.

 

Begründung

1. Historische und kulturelle Einordnung

Die Symbolik der Flagge der Eelam-Tamil:innen ist tief in der tamilischen Geschichte verwurzelt. Ihr zentrales Symbol, der Tiger, lässt sich historisch unter anderem auf das Chola-Reich zurückführen, eines der bedeutendsten tamilischen Königreiche der Geschichte. Die Nationalflagge und ihre einzelnen Symbole stehen für eine freie, gleichberechtigte und selbstbestimmte Gesellschaft. Der Tiger steht traditionell für Schutz, Stärke und kulturelle Identität. Diese Symbolik existierte lange vor modernen politischen Konflikten und wurde über Generationen innerhalb der tamilischen Kultur weitergetragen. Für die Eelam-Tamil:innen weltweit ist die Flagge daher Ausdruck ihrer Sprache, Geschichte und kulturellen Herkunft.

2. Bedeutung in der heutigen Zeit

In der heutigen tamilischen Diaspora wird die Flagge insbesondere bei öffentlichen Veranstaltungen, Gedenktagen und Zusammenkünften verwendet, bei denen Identität, Gedenken, Meinungsfreiheit, Erinnerung und Zusammenhalt im Vordergrund stehen. Die Eelam-Tamil:innen wurden und werden in ihrer historischen Heimat systematisch unterdrückt, entrechtet und vertrieben. Vertreterinnen und Vertreter der Menschenrechts- und Völkerrechtswissenschaft ordnen diese historische und bis heute anhaltende Entwicklung als strukturellen Genozid ein. Vor diesem Hintergrund besitzt die Flagge eine tiefe, emotionale und identitätsstiftende Bedeutung. In diesem Zusammenhang erfüllt sie mehrere Funktionen: Sie unterstützt die Pflege und Weitergabe der tamilischen Sprache, trägt zur Bewahrung kultureller Traditionen bei und dient als sichtbarer Ausdruck einer gemeinsamen historischen Identität. Darüber hinaus spielt sie eine wichtige Rolle bei der generationsübergreifenden Vermittlung kultureller Werte, Heimat, Erinnerung und Zugehörigkeit.

3. Bedeutung für das gesellschaftliche Zusammenleben

Deutschland ist ein Land kultureller Vielfalt. Viele Gemeinschaften bringen ihre Geschichte und Identität durch Symbole in das öffentliche Leben ein. Als Bürgerinnen und Bürger schätzen wir die Freiheiten und die demokratischen Werte in Deutschland. Gleichzeitig bringen wir durch unseren Fluchthintergrund eigene Perspektiven mit, die das gesellschaftliche Miteinander bereichern. Damit dieser Austausch gelingt, ist ein differenzierter Umgang mit unseren Symbolen von zentraler Bedeutung. Er fördert gegenseitiges Verständnis und stärkt die gesellschaftliche Teilhabe.

So wie Deutschland seine eigene kulturelle Identität schützt und lebt, ist es auch unser Anliegen als Eelam-Tamil:innen, unser kulturelles und historisches Erbe zu bewahren. Es ist unser Anliegen, diese Wurzeln zu pflegen und an nachfolgende Generationen weiterzugeben. Dadurch bauen wir für unsere Kinder eine Brücke zwischen ihrer Herkunft und ihrer Heimat in Deutschland.

 

Die Kriminalisierung der eelamtamilische Flagge:

• trägt zur Fortsetzung des strukturellen Genozids an den Eelam-Tamil:innen durch das sri-lankische Regime bei,
• führt zu einer Stigmatisierung der Eelamtamil:innen in Deutschland,
• verhindert legitime Erinnerungskultur,
• führt zu Rechtsunsicherheit in der demokratischen Teilhabe,
• steht im direkten Widerspruch zu den Werten einer inklusiven und vielfältigen Gesellschaft. 

Daher fordern wir die unverzügliche Umsetzung der folgenden, zwingend erforderlichen Maßnahmen: 

• Anerkennung der Nationalflagge
  Verbindliche Klarstellung, dass die Flagge der Eelam-Tamil:innen nicht als verbotenes Kennzeichen im Sinne des § 86a Abs. 2 S. 2 StGB gilt.
• Einstellung laufender Verfahren
  Sofortige Beendigung aller Ermittlungs- und Strafverfahren, die auf dem Zeigen der Flagge im öffentlichen Raum beruhen.
• Schutz kultureller Sichtbarkeit und Identität
  Gewährleistung der verfassungsrechtlich geschützten Grundrechte der Eelam-Tamil:innen, ihre Persönlichkeit frei zu entfalten und ihre freie Meinung zu äußern, wenn sie Identität und kollektive Trauer öffentlich und friedlich zum Ausdruck bringen.

Wir, die Eelam-Tamil:innen, sind ein integraler Bestandteil der deutschen Gesellschaft und bekennen uns uneingeschränkt zu den Werten der freiheitlich-demokratischen Grundordnung. Gerade aus dieser tiefen demokratischen Überzeugung heraus legen wir Wert auf die konsequente Wahrnehmung der im Grundgesetz verankerten Rechte. Wir nutzen die Versammlungs- und Meinungsfreiheit gemäß Art. 5 und Art. 8 GG nicht nur, um unsere kulturelle Identität frei zu leben und historische Zusammenhänge sichtbar zu machen, sondern auch, um als aktive Mitbürgerinnen und Mitbürger am gesellschaftlichen Diskurs teilzuhaben.

Protection of Cultural Identity - Against the Criminalisation of the National Flag of Eelam Tamils

Summary
For many people, the Eelam Tamil flag represents their cultural identity, language, and connection to their historical heritage. It is deeply rooted in the history, traditions, and collective memory of the Eelam Tamil people. We call for a fair assessment of this flag in Germany. The peaceful display of the flag must not be treated as a prohibited symbol under Section 86a of the German Criminal Code (StGB), as it serves as an expression of cultural identity, collective belonging, remembrance, and political freedom of expression.

Since the 1990s, the flag of the Eelam Tamils has been used worldwide as a symbol of cultural identity, language, and historical heritage. Particularly at public gatherings, commemorative events, and cultural occasions, it has established itself over decades as an important expression of collective identity. Since around 2021, there has been an increasing trend in Germany toward criminal prosecution related to the public display of the flag. In our view, this has created significant legal uncertainty due to unjustified accusations connected to a historically established national symbol.

We demand the immediate end of the criminalisation of our national flag and a clear legal and official determination that the national flag of the Eelam Tamils, as an expression of identity, remembrance and self‑determination, must not be subject to  86a subsection 2 sentence 2 of the German Criminal Code (StGB).

 

Justification

1. Historical and Cultural Placement

The symbolism of the Eelam Tamil flag is deeply rooted in Tamil history. Its central symbol, the tiger, can be historically traced, among other influences, to the Chola Empire — one of the most significant Tamil kingdoms in history. The national flag and its individual symbols represent a free, equal, and self-determined society. Traditionally, the tiger stands for protection, strength, and cultural identity. This symbolism existed long before modern political conflicts and has been passed down through generations within Tamil culture. For Eelam Tamils around the world, the flag therefore serves as an expression of their language, history, and cultural heritage.

2. Contemporary Significance

In today’s Tamil diaspora, the flag is widely used at public events, commemorative gatherings, and community occasions where identity, remembrance, freedom of expression, collective memory, and solidarity are at the forefront. The Eelam Tamils have been, and continue to be, systematically oppressed, disenfranchised, and displaced in their historical homeland. Representatives from the fields of human rights and international law have described this historical and ongoing development as a form of structural genocide. Against this background, the flag carries a deep emotional and identity-forming significance for many Eelam Tamils. In this context, the flag serves several important functions: it supports the preservation and transmission of the Tamil language, contributes to the safeguarding of cultural traditions, and acts as a visible expression of a shared historical identity. Furthermore, it plays an important role in passing on cultural values, a sense of homeland, remembrance, and belonging across generations.

3. Significance for Social Cohesion

Germany is a country shaped by cultural diversity. Many communities bring their history and identity into public life through symbols. As citizens, we value the freedoms and democratic principles upheld in Germany. At the same time, our experiences of displacement and migration bring additional perspectives that enrich social coexistence. For this exchange to succeed, a differentiated and context-sensitive approach to our symbols is essential. It fosters mutual understanding and strengthens social participation. Just as Germany protects and embraces its own cultural identity, it is also our aspiration as Eelam Tamils to preserve our cultural and historical heritage. We are committed to maintaining these roots and passing them on to future generations, thereby building a bridge for our children between their heritage and their home in Germany.

 

The criminalisation of the Eelam Tamil flag:

• facilitates the continuation of structural genocide against the Eelam Tamils by the Sri Lankan regime
• contributes to the stigmatisation of Eelam Tamils in Germany,
• undermines legitimate forms of remembrance and commemoration,
• creates legal uncertainty regarding democratic participation and
• stands in direct contradiction to the values of an inclusive and diverse society

For these reasons, we call for the immediate implementation of the following necessary measures:

• Recognition of the National Flag
  A binding clarification that the flag of the Eelam Tamils does not constitute a prohibited symbol within the meaning of Section 86a subsection 2 sentence 2 of the German Criminal Code (StGB).
• Termination of Ongoing Proceedings
  immediate discontinuation of all investigations and criminal proceedings based on the public display of the flag.
• Protection of Cultural Visibility and Identity
  Ensuring the constitutionally protected rights of Eelam Tamils to freely develop their personality and express their opinions when publicly and peacefully expressing their identity and collective grief.

We, the Eelam Tamils, are an integral part of German society and are fully committed to the values of the free democratic constitutional order. It is precisely because of this deep democratic conviction that we place great importance on the consistent protection of the rights guaranteed under the German Basic Law. We exercise our freedoms of assembly and expression under Articles 5 and 8 of the Basic Law not only to freely live our cultural identity and make historical realities visible, but also to participate in public discourse as active members of society.

எமது தேசியக்கொடியை குற்றமாக்கும் நடைமுறையை உடனடியாக நிறுத்த வேண்டும். அதேவேளை, ஈழத் தமிழர்களின் தேசியக்கொடி என்பது அடையாளம், நினைவு மற்றும் தன்னாட்சி ஆகியவற்றின் வெளிப்பாடாக இருப்பதால், யேர்மன் குற்றச் சட்டம் § 86a Abs. 2 S. 2 StGB இன் கீழ் தண்டனைக்குரிய, தடைசெய்யப்பட்ட குறியீடாகக் கருதப்படக்கூடாது என்று தெளிவான சட்ட மற்றும் நிர்வாக நிலைப்பாடு எடுக்கப்பட வேண்டும் என்று நாம் கோருகின்றோம்.

 

கோரிக்கைக்கான காரணங்கள்

1. வரலாற்று மற்றும் கலாச்சார பின்னணி

ஈழத்தமிழர்களின் கொடியின் அடையாளச் சின்னங்கள் தமிழர் வரலாற்றில் ஆழமாக வேரூன்றியுள்ளன. அதன் மையச் சின்னமான புலிச்சின்னம், வரலாற்றில் முதன்மையான தமிழ் பேரரசுகளில் ஒன்றான சோழப் பேரரசுடன் தொடர்புபடுத்தப்படுகின்றது. இந்த தேசியக்கொடியும் அதிலுள்ள சின்னங்களும் சுதந்திரமான, சமத்துவமான மற்றும் தன்னாட்சி கொண்ட சமூகத்தை பிரதிபலிக்கின்றன. புலிச்சின்னம் பாரம்பரியமாக பாதுகாப்பு, வலிமை மற்றும் பண்பாட்டு அடையாளத்தின் குறியீடாகக் கருதப்படுகின்றது. இந்தச் சின்னத்தின் பொருள் நவீன அரசியல் மோதல்களுக்கு முன்பே இருந்து வந்துள்ளது. அத்தோடு தலைமுறைகள் கடந்தும் தமிழ் கலாச்சாரத்தில் தொடரப்படுகின்றது. உலகம் முழுவதும் வாழும் ஈழத் தமிழர்களுக்கு எமது தேசியக்கொடி அவர்கள் மொழி, வரலாறு மற்றும் பண்பாட்டு வேர்களின் வெளிப்பாடாக உள்ளது.

2. இன்றைய காலத்தில் இதன் முதன்மைத்துவம்

இன்றைய ஈழத்தமிழ்ப் புலம்பெயர் சமூகத்தில், எமது தேசியக்கொடி பொதுநிகழ்வுகள், நினைவுநாள்கள் மற்றும் ஒன்றுகூடல்களில் பயன்படுத்தப்படுகிறது. இங்கு அடையாளம், நினைவு, கருத்துரிமை, ஒற்றுமை மற்றும் சமூக இணைப்பு முதன்மைத்துவம் பெறுகின்றன. ஈழத் தமிழர்கள் தங்கள் வரலாற்றுத்தாயகத்தில் திட்டமிட்டு ஒடுக்கப்பட்டு, உரிமைகள் பறிக்கப்பட்டு, இடம்பெயர நிர்ப்பந்திக்கப்பட்டுள்ளனர். இந்நிலமைகள் இன்றளவும் தொடர்கின்றது. மனித உரிமை மற்றும் அனைத்துலக சட்ட ஆய்வாளர்கள் இந்நிலமையினை வரலாற்று மற்றும் தொடர்ச்சியான கட்டமைப்புச்சார் இன அழிப்பாக வகைப்படுத்துகின்றனர்.

இன்றையசூழலில் எமது தேசியக்கொடி ஆழமான உணர்ச்சி மற்றும் பண்பாட்டு அடையாளத்தை கொண்டுள்ளது.  இதன் அடிப்படையில்:

• தமிழ் மொழியைப் பாதுகாக்கவும் பரப்பவும் உதவுகிறது,
• பண்பாட்டு பாரம்பரியங்களைப் பாதுகாக்கின்றது,
• ஒரே வரலாற்று அடையாளத்தின் தெளிவான வெளிப்பாடாகச் செயல்படுகிறது,
• தலைமுறைகள் கடந்தும் பண்பாட்டு விழுமியங்கள், தாயகம், நினைவுகொள்ளல் மற்றும் ஒற்றுமையுணர்வை பரிமாறுகின்றது.

 

3. சமூக ஒற்றுமைக்கான முக்கியத்துவம்

யேர்மனி பல்வேறு கலாச்சாரமக்கள் ஒன்றிணைந்து வாழும் ஒரு நாடாகும். பல சமூகங்கள் தங்களின் வரலாற்றையும் அடையாளத்தையும் சின்னங்களின் மூலம் பொதுவாழ்க்கையில் வெளிப்படுத்துகின்றன. குடிமக்களாகிய நாங்கள் யேர்மனியில் நிலைநிறுத்தப்பட்டுள்ள சுதந்திரங்களையும் ஜனநாயக பண்புகளையும் உயர்வாக மதிக்கிறோம். அதேவேளை, நாங்கள் தஞ்சம்கோரிய பின்னணியுடனும் இடம்பெயர்ந்த அனுபவங்களுடனும் உள்ள மக்களாக, சமூக ஒற்றுமையை மேலும் வளப்படுத்தும் தனித்துவமான பார்வைகளையும் எங்களுடன் கொண்டுள்ளோம். இந்தப் பரிமாற்றம் வெற்றிகரமாக அமைய, எங்கள் சின்னங்களுடன் நுணுக்கமாகவும், வேறுபாடுகளைப் புரிந்துகொள்ளும் வகையிலும் அணுகுவது மிக முதன்மையானதாகும். அத்தகைய அணுகுமுறை இனங்களுக்கிடையே புரிதலை மேம்படுத்துகின்றது. அத்தோடு சமூகத்தின் ஜனநாயகப் பங்கேற்பை வலுப்படுத்துகின்றது. யேர்மனி தனது சொந்தக் கலாச்சார அடையாளத்தை எப்படிப் பாதுகாத்து வருகின்றதோ, அதுபோன்றே நாமும் ஈழத்தமிழர்களாக, எமது பண்பாடு மற்றும் வரலாற்று பாரம்பரியத்தைப் பாதுகாப்பதையே எங்கள் இலக்காகக் கொண்டுள்ளோம். இந்த வேர்களைப் பேணிப் பாதுகாத்து, அடுத்த தலைமுறைகளுக்கு உரிய சொத்தாக வழங்க வேண்டியது எமது விருப்பமாகும். இதன் மூலம் எமது பிள்ளைகளுக்கு, அவர்களின் வரலாற்றுத் தோற்றத்துக்கும் அவர்கள் யேர்மனியில் உருவாக்கிக் கொண்டுள்ள தற்போதய வாழ்விடத்திற்கும் இடையில் ஒரு பாலம் அமைக்கின்றோம். 

ஈழத் தமிழர் தேசியக்கொடியை குற்றமாக்குவதன் விளைவுகள்:

• சிங்கள, பௌத்த பேரினவாத சிறிலங்கா அரசு ஈழத்தமிழர்கள் மீது மேற்கொண்டுவரும் கட்டமைப்புசார் இன அழிப்பு நடவடிக்கைகளுக்கு இது போன்ற தடைகள் மேலும் வலுவூட்டுவதாக அமைகின்றது,
• யேர்மனியில் வாழும் ஈழத்தமிழர்களை களங்கப்படுத்துவதற்கு வழிவகுக்கிறது,
• உரிமைசார்ந்த நீதியான நினைவுகூரற் பண்பாட்டினைத் தடுக்கின்றது,
• ஜனநாயகப் பங்கேற்புடன் தொடர்புடைய சட்டப் பாதுகாப்பின்மையை உருவாக்குகின்றது,
• பன்முகத்தன்மையுடன் இருக்கும் சமூகத்தின் விழுமியங்களுக்கு நேரடியான முரண்பாடாக நிற்கின்றது.

ஆகையால், கீழே குறிப்பிடப்படும் அதிமுதன்மையான நடவடிக்கைகள் காலதாமதமின்றி உடனடியாக செயல்படுத்தப்பட வேண்டுமென நாம் கோருகின்றோம்:

  ஈழத் தமிழர்களின் தேசியக் கொடி, யேர்மன் குற்றச்சட்டம் § 86a Abs. 2 S. 2 StGB இன் அடிப்படையில் தடைசெய்யப்பட்ட குறியீடாக அமையாது என்பதனை சட்டரீதியாக தெளிவுபடுத்தப்படவேண்டும்.
• நடைபெற்று வரும் வழக்குகளை நிறுத்துதல்
  பொதுவெளியில் எமது தேசியக்கொடியை காட்டியதற்காக தொடுக்கப்பட்டுள்ள அனைத்து  குற்றவியல்விசாரணைகளையும் உடனடியாக நிறுத்த வேண்டும்.
• வெளியான பண்பாட்டு பார்வையும், அடையாளமும் பாதுகாக்கப்படுதல்
  ஈழத்தமிழர்கள் தமது அடையாளத்தினையும் கூட்டுத்துயரத்தையும் அமைதியான முறையில் வெளிப்படுத்தும்போது, அவர்களின் தனிநபர் வளர்ச்சிக்கும் கருத்துரிமைக்கும் அரசியலமைப்புச் சட்டம் வழங்கும் அடிப்படை உரிமைகள் உறுதி செய்யப்பட வேண்டும்.

ஈழத்தமிழர்களாகிய நாம் யேர்மன் சமூகத்தின் ஓர் அகற்ற முடியாத அங்கமாக இருக்கின்றோம், மேலும் சுதந்திர ஜனநாயக அடிப்படை ஒழுங்கின் விழுமியங்களுக்கு முழுமையாக உடன்படுகின்றோம். இவ்வாறான ஆழ்ந்த ஜனநாயக நம்பிக்கையிலிருந்தே, அரசியலமைப்புச்சட்டத்தில் பதியப்பட்டுள்ள உரிமைகள் தொடர்ந்தும் தளர்வின்றி நடைமுறைப்படுத்தப்பட வேண்டுமென நாம் உரிமையுடன் வலியுறுத்துகின்றோம். யேர்மனியின் அரசியலமைப்புச்சட்டத்தின் (Grundgesetz) 5 ஆம் மற்றும் 8 ஆம் உறுப்புரைகளில் நமக்குக் கிடைக்கும் ஒன்றுகூடும் மற்றும் கருத்துச் சுதந்திரத்தின் படி எமது பண்பாட்டு அடையாளத்தை பயன்படுத்தி சுதந்திரமாக வாழவும், வரலாற்று தொடர்புகளை வெளிப்படுத்தவும், ஒன்றுபட்ட குடிமக்களாக சமூக விவாதங்களில் பங்கேற்கவும் அனுமதிக்க வேண்டுகிறோம்.
