In March, the Zoning Administrator for the City of Chicago has ruled that Guidepost Montessori at Magnificent Mile qualifies as a school under the legal definition provided in state law. This school is within 500 feet of 620 N Fairbanks, and that makes the location ineligible to be used as a cannabis dispensary under the Chicago Zoning Ordinance.
Latest Update:
The dispensary applicant is appealing the Zoning Administrator's ruling, and on Friday at the Chicago Zoning Board of Appeals (ZBA) meeting, their lawyer asked for a continuance so the appeal could be heard by a ZBA full board as there were only 3 board members present on Friday. The appeal was continued to May 17 at 9am.
If the ZBA upholds the Zoning Administrator's decision on May 17 at 9am, then that is the end of the application with the ZBA (but the applicant could take the matter further to the Circuit Court of Cook County). However, if the ZBA overturns the Zoning Administrator's decision, then the dispensary's hearing will proceed and we will update you of that hearing date as we learn more.
