Oppose bail for Wandile Nsabande in new criminal cases
Das Anliegen
PREAMBLE
We, the undersigned concerned citizens of South Africa, call upon the National Prosecuting Authority to carefully consider opposing bail should Wandile Nsabande appear in court in connection with new criminal charges arising from alleged conduct following his release on parole.
We understand that Mr Nsabande was previously convicted in a criminal matter dating back to 2009 involving attempted murder, theft and hijacking, and that he was subsequently released on parole. We request that the State verify the details of the previous convictions, sentence and parole conditions and place any legally admissible and relevant information before the court.
We are concerned by allegations of further unlawful conduct, including assaulting police officers, intimidating members of the public and involvement in incidents in which businesses have allegedly been damaged.
These allegations must be investigated and assessed on the available evidence. However, if new criminal charges are brought and credible evidence supports the concerns outlined below, we believe the prosecution should carefully assess whether release on bail would be consistent with the interests of justice and public safety.
1. CONCERNS REGARDING PUBLIC SAFETY
South Africa’s Constitution protects the rights, dignity and safety of all people.
The right to peaceful assembly and freedom of expression does not authorise assault, intimidation, malicious damage to property or other criminal conduct.
Where there is credible evidence that an accused person has committed further offences while on parole, the prosecution should place the relevant facts before the court when bail is considered.
We therefore request that the State investigate and present any admissible evidence relevant to the following concerns:
Allegations of assault against police officers or other individuals.
Allegations of intimidation or threats against members of the public.
Allegations of damage to businesses or property.
Any verified previous convictions relevant to the bail determination.
Any documented breach of parole conditions.
Any evidence relevant to the likelihood of further offences if bail is granted.
2. REQUEST THAT THE STATE OPPOSE BAIL WHERE JUSTIFIED
We respectfully request that the prosecution oppose bail if the available evidence provides lawful grounds to do so.
Under section 60 of the Criminal Procedure Act 51 of 1977, a court considers the interests of justice when deciding whether an accused person should be released on bail.
Relevant considerations may include whether the accused is likely to commit a Schedule 1 offence, whether the safety of the public or particular individuals may be jeopardised, whether the accused may intimidate witnesses, and other applicable statutory factors.
We therefore ask the prosecution to assess the evidence carefully and make appropriate submissions to the court concerning:
The seriousness of the new allegations and the circumstances in which the alleged offences occurred.
Any verified previous convictions and their relevance to the bail application.
Any evidence that the accused has breached existing parole conditions.
Any credible risk of further offences, intimidation of witnesses or interference with the investigation.
Any other relevant circumstances bearing on the interests of justice.
We request that the prosecution seek the denial of bail if the evidence satisfies the applicable legal requirements.
3. REQUEST FOR A THOROUGH INVESTIGATION
We call upon SAPS to investigate the reported incidents impartially and to preserve relevant evidence, including witness statements, police reports, video recordings and other material that may assist the investigation.
We further request that the Department of Correctional Services provide the appropriate authorities with relevant information about Mr Nsabande’s parole conditions and any documented breaches, subject to applicable legal requirements.
If new charges are instituted, we ask that the prosecution ensure that all relevant and admissible information is properly presented to the court.
4. PROTECTION OF WITNESSES AND MEMBERS OF THE PUBLIC
We are concerned about the possibility that witnesses or members of the public could face intimidation if credible threats or previous incidents support such a concern.
We therefore request that the State assess any evidence of threats, witness intimidation or interference with the investigation and seek appropriate protective measures where necessary.
No witness or member of the public should be threatened or intimidated for cooperating with law enforcement.
5. OUR DEMAND
We, the undersigned, respectfully call upon the National Prosecuting Authority to:
Assess whether bail should be opposed if Mr Nsabande appears in court on new criminal charges.
Present verified previous convictions, relevant parole information and admissible evidence to the court where legally appropriate.
Oppose bail if the evidence establishes grounds under the Criminal Procedure Act.
Ensure that any risks to public safety, witnesses or the administration of justice are properly considered.
Investigate any alleged parole violations through the appropriate authorities.
Keep the complainants informed of the appropriate complaint and follow-up procedures, subject to legal and confidentiality restrictions.
CONCLUSION
Our appeal is for public safety, accountability and equal application of the law.
We recognise that every accused person is presumed innocent of new charges unless proven guilty in accordance with the law. We also recognise that the decision to grant or refuse bail rests with the court after considering the evidence, the applicable legislation and the interests of justice.
We therefore ask the prosecution to examine the available evidence rigorously and to oppose bail if the legal grounds for doing so are established.
We call for a fair, evidence-based decision that protects the public while respecting the Constitution and the rights of all parties.
Signing this petition is an act in favor of justice and safety. It will echo the cries of those who have been marginalized and ignored while those who misuse the judicial system walk free. Join me in calling for stricter bail measures and demanding accountability and protection for every individual’s right to live without fear. Please sign and share this petition to initiate change.
Update: Bail has been granted for a R1000 and bail conditions set that not to approach State officials and stay away from Home Affairs Offices atleast 500m and needs court approval to visit the Home Affairs Office. The accused persons return to court in the 25th and 26th November 2026 regarding the charges. We await further details in November 2026.
