ODTÜ’de İki Sendikalı Çalışanın İşten Atılmasını Durdurun!

Orta Doğu Teknik Üniversitesi’nde geçtiğimiz Aralık ayında maaş promosyon ihalesi sürecinde Rektörlüğün belli bankaları tarif eden bir şartname ile ihaleye çıkmak istemesi üzerine üç gün boyunca okulda hayatı durduran bir grev yaşanmıştı. 12 Eylül’den bu yana üniversitelerde yaşanan en büyük emekçi eylemi olma özelliği taşıyan ODTÜ grevinin ardından yetkili sendika konumundaki Eğitim Sen’in işyeri temsilcisi önce asistan olarak çalıştığı işyerinde bir profesör tarafından darp edilmiş ardından da sudan sebeplerle işten çıkarılmıştı. Şimdi de sendikal mücadelenin öncülerini disiplin soruşturmaları ile cezalandırmaya, önemli bir mücadele deneyimi ortaya koyan ODTÜ emekçilerini sindirmeye çalışıyorlar.

Eğitim-Sen Ankara 5 No’lu Üniversiteler Şubesi örgütlenme sekreteri araştırma görevlisi Mert Kükrer ve Şube Denetleme Kurulu üyesi teknisyen Barış Çelik işten atma tehdidi ile karşı karşıya. Her iki çalışanın da dosyaları kamu görevinden çıkarma talebiyle ODTÜ yönetimi tarafından YÖK’e gönderildi. Üç önde gelen sendika üyesi ise eğitim öğretimi engelleme suçlaması ile ODTÜ’nün verebileceği en yüksek ceza olan kademe ilerlemesinin durdurulması cezasına çarptırıldı. Toplumsal mücadelenin önemli taşlarından ODTÜ’de emekçileri sindirmek hedefiyle sendikal faaliyetin baskı altına alınmasına karşı herkesi dayanışma içinde bulunmaya davet ediyoruz.

Bu soruşturma dalgası ile devrimciliği ve demokratlığıyla ün salmış olan ODTÜ'de eylem yapmak bile ceza sebebi olmuş, sendika üyeleri psikolojik şiddete maruz bırakılarak yoktan sebeplerle işten atılmaya varan cezalarla yüz yüze gelmiş, düzenlenen 1 Mayıs etkinliği dahi soruşturma konusu haline getirilmiştir.

Soruşturma sürecinin hukuksuzluğu, alınan kararların ODTÜ emekçilerinin sesini bastırmaya yönelik politik bir hamle olduğunu göstermektedir. Bu kararların tam da ODTÜ tarihinde görülmüş en büyük grev ve eylemlilikler sonrası gerçekleşmesi manidardır. Berkin Elvan boykotu, Soma grevi, çalışanların şikayet ve taleplerini dile getirdikleri sandık eylemleri, Büyük Emekçi Yürüyüşü ve nice eylem ve etkinlik yalnızca AKP iktidarını değil ODTÜ yönetimini de rahatsız etmiş, adeta bir engizisyon mahkemesine dönüştürmüştür. Bugün ODTÜ geleneğini bankalarla, şirketlerle, hatta bu örnekte görüldüğü üzere YÖK ve iktidar ile kol kola giren yönetim değil mücadele içindeki ODTÜ çalışanları ve ODTÜ öğrencileri temsil etmektedir.

 

Soruşturma sürecinde
· Soruşturmaya uğrayan üyelerimiz “Yükseköğretim Kurumları Yönetici, Öğretim Elemanı ve Memurları Disiplin Yönetmeliğine” aykırı biçimde dayanaktan yoksun suçlamalarla karşı karşıya kalmıştır. Soruşturma çağrısında hangi maddeye göre suçlandıkları dahi belirtilmeyerek üyelerimizin savunma haklarını sağlıklı biçimde kullanmaları engellenmiştir.

· Sendika avukatının, Avrupa İnsan Hakları Mahkemesi içtihatlarına aykırı biçimde savunma sırasında suçlanan üyelerimizin yanında olmasına izin verilmemiştir.

· Kararların alındığı Üniversite Yönetim Kurulu toplantılarına sendika temsilcisi yine hukuka aykırı olarak çağrılmamıştır.

· Hakkında şikâyet olmayan üyelerimiz için soruşturma açılmış, ancak hakkında şikâyet olan kişilere soruşturma açılmayarak başka bir hukuksuzluk örneği sergilenmiştir.

· Soruşturma açılan suçlama ile ceza verilen suçlama birbirinden farklıdır. Bu biçimi ile soruşturma hukuka aykırıdır.

· Soruşturma komisyonunu baskı altına almayı hedefler biçimde, soruşturmalar başlamadan 24.12.2014 tarihinde yapılan açıklama ile Üniversite Senatosu açıkça taraf olduğunu kamuoyuna ilan etmiştir.

Bu süreç sonucunda, soruşturmaya uğrayan kişilere ve sendikamıza karşı başlatılan linç kampanyasının bir sonucu olarak, yasal dayanaktan yoksun ve kabul edilemez cezalar verilmiştir.

Alınan kararlar,
· Türkiye Üniversitelerindeki gerici uygulamaların, öğrenciler ve emekçiler üzerindeki baskıcı tutumların yeni bir tezahürüdür.

· Anayasal bir hak olan sendikal hakların engellenmesine ve hak arama girişimlerine yönelik gözdağı vermeyi amaçlayan bir saldırıdır.

Verilen cezaların ve soruşturmaların akademik özgürlük anlayışından, inandırıcılıktan uzak ve toplumsal sorunlara duyarlı, tüm emekçileri sindirmeye yönelik olduğunu çok iyi biliyor ve başta üniversite bileşenleri olmak üzere tüm kamuoyunu bu ve benzeri haksızlıklar karşısında taraf olmaya, adil olmayan biçimde cezalandırılan üyelerimizle dayanışma içinde bulunmaya çağırıyoruz.

STOP THE UNION MEMBER LAYOFFS AT METU!

In December 2014, Middle East Technical University (METU) workers went on a three-day strike to protest the university administration’s shady financial affairs. During the bidding process for the employees’ salary promotions, administration deliberately favored certain commercial banks over others. This three-day strike is the largest workers’ protest at universities since the days preceding 1980 Military Coup.

In the aftermath of the strike, METU’s workplace representative of the Education and Science Workers’ Union (Egitim-Sen) – who was employed as a research assistant at the time- was assaulted by a professor. Shortly after the physical assault, Egitim-Sen representative was laid off by the university administration based on thin excuses and unsupported claims.

Today, the METU administration attacks other active members of Egitim-Sen by taking discretionary disciplinary action. Administration does its best to suppress the strong opposition to its corrupt financial engagements that flourished with the union’s confrontation.   

Mert Kukrer (Egitim-Sen Universities Branch Organizing Secretary, Research Assistant) and Baris Celik (Egitim-Sen Universities Branch Supervisory Board Member, Technician) face the risks of potential layoffs. METU administration has passed both Kukrer’s and Celik’s cases to the Council of Higher Education (YOK) demanding their layoffs from METU and lifetime disqualification for public employment.

Moreover, three other Egitim-Sen members at the forefront of the protests are accused of “disrupting the educational activities”. METU administration has agreed on “statutory freeze” for these three academics. This is the harshest penalty the administration may give for an employee.

METU workers have always been at the forefront of social struggles for justice. Oppression that organized labor in METU faces is intolerable. We must get our voices united and raised not just to stop layoffs and discretionary disciplinary action the union members at METU faces, but also to fight the authoritarian regimes’ attack on labor unions. 

This series of investigations criminalize the right to protest and it contradicts with the revolutionary and democratic legacy of METU. Disciplinary actions inflict psychological stress on union members and threaten their job security. As a direct consequence of this investigation process, even the Labor Day events have been subject to University Administration’s scrutiny.

The investigations have been carried out unlawfully. This also suggests that the accusations and potential punishments are politically motivated and basically aim suppressing the labor’s voice in METU. It is important to note that the Administration is taking all these actions right after one of the largest protests in METU’s history.

 Unlawful practices during the investigation process include the following:  

-      Investigations violate the procedures specified by “Higher Education Institutions Administrator, Faculty and Officer Discipline Bylaw” both in terms of the methodology and the content of accusations. The accusations are not explicitly declared to the investigated union members, which violated their right of defense. 

-      Our union attorneys are not allowed to accompany accused union members during their defenses. This is against the European Court of Human Rights Case-Laws.

-      Egitim-Sen union representative is unlawfully excluded from the University Administrative Committee meetings as the union members’ cases were discussed.

-      University Administration chose not to investigate employees for whom complaints have been filed. However, they started investigating employees with no filed complaints. This arbitrary and discretionary practice is extrajudicial.

-      The investigations are based on accusations that are different from the ones in the final decisions. This discrepancy between the accusations and punishments is against the law.

-      University Senate made a biased declaration on December 24, 2014 which violates its neutrality about the union members’ disciplinary cases. University Senate’s public declaration of favoritism put significant pressure on investigation commission and reduced the commission’s chances of being objective. 

This lawless investigation process has led to extrajudicial punishment of Egitim-Sen union members at METU.

This investigation is a manifestation of bigotry, a case of oppressive attack on students, workers and universities in Turkey. It is also against the law as the union right is a constitutional right. These actions ultimately aim suppressing the labor’s voice at the workplace.

The statutory freeze penalties and the potential layoffs of union members undermine the universal values of academic freedom and academia’s social responsibilities.

We urge everyone to take sides in this fight between the oppressive university administration backed by the Council of Higher Education and the free voice of labor represented by union members at METU. We make a call to international community to express their solidarity with the Egitim-Sen members at METU in their fight against the unlawful layoffs and disciplinary charges.
