While I am completely aware that this may have little impact. Sitting and waiting for our phones to ring with good news has only proven unlikely and we are left with limited options but to proactively fight this injusice in anyway available.
The reason that the Building Commission introduced "reform" in 2023 was following Mascot and Opal Towers. Because these matters were heavily reported on in the media it became "public interest". Public interest is written into their enforcement policy as a contributing factor that guides their enforcement response. We gain nothing by airing our dirty laundry for everyone to see but remain hopeful that this fight will be worth it one day.
What we have learned over recent weeks is that our matter "the failed rectification order" is the first of its kind being challenged in court, to add to the complexity of that, we have now also filed against out builder.
Unfortunately the Building Commission continue to maintain that they cannot commence disciplanary investigation or proceedings until the building investigation is closed - despite the more serious allegations we have made, heavily supported by evidence. This building investigation is into it's 13th month. It is imperative that the Building Commission aknowledge that a "conduct" investigation needs to happen in parallel to protect consumers, failing to do this allows for an "alleged" criminals to be given work orders they have failed to comply with.
