The Issue
Simple cases of Builder taking 90% payment from buyers and not delivering apartments to home buyers even after a delay of 4 to 6 years have been going on in NCDRC for about 4 -6 years now. These are open and shut cases of Builders cheating buyers. However our Judiciary is blatantly favouring the builders because they have muscle, money and political clout.
A case of over 450 buyers, who have jointly filed a case against a big time builder of Gurgaon, is one such example. On each hearing the Builder Lawyers use a tactic of sending a junior lawyer who just has no clue what to say except “sorry maam, can we get more time” the junior lawyer or the senior lawyer in 4 years has not been able to come up with any substantial reason why they should not pay the Penalty amount to Buyers for causing a delay of over 6 years. The judge has been scolding the junior lawyer in court (like it were a class room) and granting them a next date (new date) every time. The dates are spaced out anywhere between 6 months to over 13 months.
These Home Buyers are dying under the pressure of EMI, and all they can do is bear this excruciating occurrence on every hearing in court. This case could have long been closed with a final hearing, about 2-3 years ago. But the prolonging and delaying tactics of the Builder and the Lawyers have ensured that this case will just keep dragging till eternity.
How does NCDRC have the time and energy to stretch such simple cases that can be closed within a year! They have more than enough cases going on in the consumer court and their priority should be to give Final verdict within a limited time frame of 6-12 months.
Judges acting like teachers and “scolding lawyers” for not coming up with the required evidence (for not doing their homework) for the 10th time is not acceptable. The court is not a class room. A lawyer is not a child that will be admonished in front of people and then be granted another hearing, just because of his/her child like behaviour. Whereas 450 home buyers will just keep suffering in silence, mind you out of these 450 home buyers there are a lot of senior citizens as well. People have put in their life’s savings to buy a home and all that they get to see in the name of justice is lawyers being scolded by judges.
This is just not acceptable, request people in the Judiciary to take responsibility and ensure justice for these cases within 6 -12 months. Our case has been going on for 4 years and the next hearing date will make it 5 years!! The chief justice needs to look into this matter and ensure an early closure of our case.
The question is why would the judiciary want to drag cases for several years; it just increases their work load. There has to be some gain somewhere for them showing such great motivation.
We must show the designated authorities right away that there is massive public outrage, outcry and opposition to these occurrences in the court room and the entire legal system.
We must unite and have our voices heard.
