Petition updateMorris Lester:Demand Justice from Mexico and UK Governments to protect him and his 2 sons.

UPDATE: Trial Date 11th November 2026 - In Contact With UK Envoy For Detained Britons Overseas*

Morgan LesterAyrshire, SCT, United Kingdom
Oct 16, 2026

I want to say a huge thank you to everyone who has signed, shared and supported the petition for me and my two sons.

My trial for the crime that never happened is now set for *11th November 2026*.

I am now in contact with Sir Alastair Burt, the UK Government's first ever Envoy for complex consular detention cases for Britons Imprisoned Overseas.

I would like to say a huge thank you to him and to Maureen Burke MP for Glasgow North East who is also helping to investigate and raise awareness within the Scottish and British Government.

*What I have learned from my case file:*

The prosecution (Fiscalía) have refused to seek exculpatory evidence. They have suppressed evidence that helps my defence.

I changed lawyers around ten weeks ago. In that time, the Fiscalía have refused to hand over the complete case file.

My new lawyers still do not have a copy of the whole file.

This in itself is suppression of evidence and a federal crime.

Under *CNPP Art. 131* the prosecutor must seek BOTH incriminating and exculpatory evidence. Under *CNPP Art. 113 and 117* the defence has the right to access the full file.

I am NOT asking for favourable treatment. I am asking for a fair and thorough investigation and at the very least my legal right to get the procedure RESTARTED so that we can demand the suppressed and un-investigated evidence.

Under Mexican law this is called *Reposición del Procedimiento - CNPP Art. 97, 101, 482*. If the prosecution suppresses exculpatory evidence and denies the full file for 10 weeks, the investigation is invalid and must be restarted.

I will be requesting that my lawyers file the *Incidente de Nulidad y Reposición and Solicitud Art. 129 CNPP* for the Judge to order the Fiscalía to investigate the exculpatory evidence they refused, as soon as we get a full copy of the file.

This is minimum due process, not a favour.

Under *Constitution Article 20 B IX and CNPP Art. 165*, preventive custody cannot exceed 2 years. I have been held *3 years and 2 months in CDMX without a sentence* - 1 year and 2 months OVER the constitutional maximum. So under *CNPP Art. 161* the Judge must replace prison with *Art. 155 measures* - signature, electronic bracelet, prohibition to leave Mexico.

This is mandatory under Supreme Court *Amparo 315/2021*.

This is not one mistake, it is multiple federal crimes.

The Fiscalía, by not seeking exculpatory evidence and suppressing evidence, as public servants are committing federal crimes:

*1. Not seeking exculpatory evidence + suppressing it:*

*Art. 225 Fraction XIII* - 4 to 10 years

*Art. 225 XXXII* - 8 to 15 years

*Art. 225 VII and VIII* - 3 to 8 years each

*2. Refusing to hand over the complete file for 10 weeks:*

*Art. 225 XIII and VIII* - plus violation of Constitution Art. 20 - right to adequate defence

*3. Over 2 years without sentence:*

I have been held 3 years 2 months without sentence, beyond the 2-year limit. Violates Constitution Art. 20 B IX and CNPP 165.

*Art. 225 Fraction X* - 4 to 10 years

*CDMX Art. 299 VI* - 2 to 8 years

*4. Human Rights Violations:* Presumption of innocence, due process, prolonged arbitrary detention, psychological torture.

*5. My children:*

My children have been the subject of two forced removals from their mother's custody. By two different child protective services, two different family courts, two different family departments, with the help of multiple government psychologists in two different states, after two Amber Alerts.

There is an open investigation into aggravated child abduction also.

The mother has unsupervised weekend access.

I and their family in Scotland have had zero contact since the day of my arrest three years and two months ago, even although I am their legal guardian.

*6. Why this matters — World Justice Project:*

According to the *World Justice Project Rule of Law Index 2025*, Mexico ranks *121st out of 143 countries worldwide, 28th out of 32 in Latin America and the Caribbean, and 38th out of 41 upper-middle income countries.*

By the factors that measure corruption in government and justice:

- *Absence of Corruption: 134th out of 143*

- *Criminal Justice: 135th out of 143*, just ahead of Venezuela, Bolivia and Nicaragua

- *Order and Security: 132nd out of 143*

WJP finds Mexico's judicial independence under threat and shrinking civic space.

I am held 3 years 2 months in CDMX without sentence in a system ranked 134th for absence of corruption and 135th for criminal justice. This is the type of corruption-free investigation failure that the WJP Index measures.

This is why I and my sons desperately need your help and international observation.

I have asked Sir Alastair Burt and the Complex Consular Detention team at the FCDO to urgently review my case, demand a fair hearing, and request an investigation into the conduct of the prosecution before my trial starts.

With this level of corruption on the record, I am not expecting a fair trial without international observation.

We are still desperate to raise funds - not just to fight for my legal defence and to ensure a fair trial, but to protect my children and fight for their safe return.

*NO estoy pidiendo trato favorable.

*1. No buscar prueba de descargo + suprimirla:*

*Art. 225 Fracción XIII* - 4 a 10 años

*Art. 225 XXXII* - 8 a 15 años

*Art. 225 VII y VIII* - 3 a 8 años cada uno

*Art. 225 Fracción X* - 4 a 10 años

*Art. 299 Fracción VI de CDMX* - 2 a 8 años

*4. Violaciones a Derechos Humanos:* Presunción de inocencia, debido proceso, detención arbitraria prolongada, tortura psicológica.
