17th of May 2018 MAYOR DE LILLE IS NOT A CEREMONIAL MAYOR – SHE HAS ALL THE POWERS SHE HAD BEFORE SHE WAS OUSTED BY THE DA. Dear supporters of this petition Thank you for your continued support. Our petition now stands at 1,827 supporters and growing each day. Mayor De Lille has been restored as the Mayor of Cape Town with all her powers exactly as they were before the expulsion. The DA is undermining the Judiciary by spreading a false narrative, namely, that Mayor De Lille has lost all her powers as the Executive Mayor of Cape Town and she has become a ceremonial Mayor only. This erroneous view is not supported by the judgment as indicated by items 34 and 35 in the said judgment: “[34] As undesirable as it may be in light of the bruising allegations and counter allegations which have been made in these proceedings, preservation of the status quo as it existed immediately before Ms. de Lille was informed of the decision of FedEx last Tuesday morning is in our view the only reasonable alternative in the prevailing circumstances. The DA will know this only too well after its protracted litigation with the former Chief Operating Officer of the national broadcaster in which it sought to preserve the status quo. See Democratic Alliance v South African Broadcasting Corporation and others 2015 (1) SA 551 (C). There is, in our view, no practical way to achieve this outcome other than to grant the relief sought by Ms. de Lille in para 1.1 of the draft order handed up by Mr. Mpofu. [35] It goes without saying that in asking for her party membership to be guaranteed pendent lite, Ms.de Lille impliedly warrants that she will continue to serve all of the people of Cape Town on behalf of the DA and in accordance with its policies. She must further be taken to warrant that she will subject herself to party discipline in the interim and that she recognizes that the party is entitled to enforce such discipline against her by acting lawfully in accordance with the provisions of its constitution.” Immediately, after the judgment on Tuesday, News 24 reported the following: “Deputy Mayor Ian Neilson on Tuesday told News24 that De Lille would be a "lame duck" mayor, with the DA caucus calling the shots in the City. "She can sit in the office and drink tea, and drive around in CA1 but she's just not going to be able to do anything other than ask for oversight, because the DA caucus is essentially going to call the shots," said Neilson.” (see sources below) Neilson’s response to the judgement is disappointing, to say the least. Why should we, as the voters of Cape Town, respect the DA Caucus, The DA FedEx or Mayco members who undermine the court judgement in favour of their own narrative? Councillor Xanthea Limberg continues this false narrative by repeating the erroneous interpretation of Neilson by stating the following: 1. “…the Mayor has no authority to make decisions…” (wrong – the Mayor still has full authority) 2. “…all decisions will take place in a collective fashion through the Mayoral committee as well as through the DA Caucus of Cape Town” (wrong again – the full council consisting of ALL THE PARTIES, is the highest decision making body, not the DA Caucus. 3. “…and we believe that the Mayor’s return to office puts this (i.e. clean governance) at jeopardy and we will continue to strive for a clean administration and keep corruption out (implying that Mayor De Lille is corrupt) and therefore we do not believe that the Mayor’s return to office is in the interest of the people of Cape Town.” If the DA does not approve of the ruling of Judge J. Gamble, the correct procedure is to take his decision on appeal, not to squeal like spoilt brats.
