The RTI was transferred by the above Ministry, on 12/09/2018, to the Department of Empowerment of Person with Disabilities (Divyangjan) and Registered as DODAF/R/2018/80442, which, too, transferred to the Office of the Chief Commissioner for Persons with Disabilities, registered as OCCPD/R/2018/80058 which disposed the RTI vide its order 14/09/2018

Reply :- no action has been taken on your email dated 07/09/2017.

However, it is informed that your request for incorporating the penal provisions in the Rights of Persons with Disabilities Act, 2016 and to provide protection and adequate safeguards to the differently abled population, from the widespread abuse of the 498-A IPC & Protection of the women from the Domestic Violence Act-2005 ( PWDV Act-2005) is beyond the jurisdiction and mandate of the O/o Chief Commissioner for Persons with Disabilities.

Grounds of Appeal:

As the representation was send to Ministry of Social Justice and empowerment as well to the Office of the Chief Commissioner for Persons with Disabilities. The concerned Ministry has not provided any information on the representation received by them. Moreover, the Office of the Chief Commissioner for Persons with Disabilities has clarified their position, and hence the CPIO, ministry of social justice and empowerment, only, has to provide the information available on records, which the office of the Commissioner of the disabilities has not even transferred to the Ministry for their disposal
