Courts, in some case suo-moto, are deleting old Provisions of law and considered them as unconstitutional. Whether the empirical studies have been placed on their tables to derive conclusions? whether Courts can frame the laws? Whether opinions of the Public through their representatives has been called upon through healthy debate which can only be held in parliament. Just because I think is unconstitutional could not be unconstitutional, unless views of the large segments of the society have been called for, which can only be exercised in the parliament. The powers of Judicial review could be invoked without any aggrieved persons, as we have seen in the case of Adultery? seeking solutions for the above queries..pl help
