AS CHARGES AND SENTENCING GO these days multiple charges for one criminal event are applied liberally and sentenced accordingly though often considered concurrent. The charges against Tim Murphy emanate from the rape of a young woman by someone who entered her apartment with a key, raped her, stole a small sum of money, thereby accruing multiple charges, i.e. Criminal Sexual Conduct, Unarmed Robbery, Breaking& Entering and in Tim’s case Habitual Criminal. Tim had former escapades in thievery and non-violent sexual delinquency, hence the suspicion cast. There was an apartment maintenance man on location with master keys whose visiting brother abruptly left for another state, neither having been interrogated. The sentences imposed were: 40 to 60 years; 40 to 60 years; Parolable Life; Parolable Life; Parolable Life; Parolable Life all for the same crime, with an additional 1 Day to Life for a slightly previous delinquency charge. This is an obvious overkill considering the fact that murder convictions often garner lesser sentences.
Questionable partial DNA evidence established no concrete results even with a specialist describing what were probabilities at best during trial. Physical descriptions of the attacker did not match Mr. Murphy’s physical bearing nor could the victim identify him. Physical evidence such as hair was inconclusive and non-technical.
He has been incarcerated for near twenty-eight years inclusive of a former conviction from 1986, a troubled youth, shaky family circumstances, drugs and alcohol abuse per sociological profile. He claims innocence of the charges although readily admits to younger age diversions in the illicit realm, the implication being the quotidian “getting caught for the crimes he got away with” regardless of actual guilt. As chronicled elsewhere, Parolable Life sentences are ineligible for remediate therapy courses such as Sexual Offender Psychotherapy (SOP), the obvious oxymoron being that despite being parolable, such categories of prisoners are restricted from therapy due to the Life stigma. This is oxymoronic since even though claiming innocence of the conviction and though he is willing to attend therapy sessions he is prohibited from doing so, hence ineligible for parole. This is a paradoxical Catch-22. These barriers were implemented in the Tough On Crime era Nixon through Bush II with strong complement by Bill Clinton, mostly misguided attempts at mollifying public concern resulting in unintended consequences.
He’s a changed man from hitherto 28 years ago, does paralegal work for himself and others incarcerated. A daring prison break attempt in 2007, chronicled dramatically in Esquire Magazine in 2008, is the only true black mark on his record, a Papillon, or Shawshank Redemption type effort by one who is innocent of charges convicted. Of note is the fact that the escape tunnel was finished one week before discovery but escape was delayed due to the pact amongst the four involved that no crimes would be committed during or after escape.
They were waiting for a getaway driver to coordinate, intent on just disappearing without a trace. Tim is fifty years of age, time enough served. Having “exhausted” all appeals per usual Tim seeks commutation/parole or pardon as his upcoming 2016 review extends this possibility. Being withheld from the SOP program threatens this plausible denouement but gubernatorial intervention could supersede. These Change.org petitions have already been proven to have saved many persons from unjust circumstances, medical, incarceration, immigration &c.
This commutation potential seems to us and related affiliates a progressive rehabilitation that will not beget recidivism. He holds no grudges for wrongful conviction and feels he is indeed doing time for past indiscretions long paid for. There is a potential for commutation or pardon in 2014 through Governor Rick Snyder if enough signatures are garnered, hence this petition. People do change over the course of time and Tim’s surely had enough time. Your signature support is very much appreciated. Help free an innocent man of convicted charges overly sentenced for former activities for which he has exhibited contrition. There but for fortune go you and I. As most of us know, the overturning of 300 wrongful convictions through Innocence Projects illustrates the plight of the American system of justice.
