The post-Panel process for a planning scheme amendment is:
Because this is a major matter, the Panel will have 40 business days from the conclusion of the Hearing to submit their report (early February 2023).
Council must consider the Panel’s report.
Council must make the report publicly available.
Council may adopt the amendment with or without changes, or abandon it. If it adopts the amendment, it must submit it to the Minister for approval.If it departs from any recommendations of the Panel, it must explain why to the Minister. If Council adopts the amendment, the Minister then approves or rejects it.
The Minister can approve an amendment, or a part of it, with or without changes and subject to conditions.If approved, the amendment comes into effect when notice of approval is published in the Government Gazette.
