

As of 24 Feb 2026, the Supreme Court ruled in a 5–4 decision that the U.S. Postal Service (#USPS) cannot be sued for damages regarding lost, misdelivered, or intentionally withheld mail.
The ruling upheld that the Federal Tort Claims Act (FTCA) of 1946 shields the agency from liability even in cases of intentional misconduct by employees like mismanagement in the transport of live animals.
Sovereign Immunity: The government's sovereign immunity applies to the Postal Service, protecting it from lawsuits regarding "negligent transmission" of mail, which includes intentional, malicious withholding.
Liability Limitations: USPS policy restricts liability to specific services, such as insured or registered mail, not general mail delivery.
Individual Liability: While the agency is immune, individual employees may still be held liable for interfering with mail delivery, but the USPS cannot be sued.
Thought for Breeders of Military Pigeons: It may be in the best interest of breeders to begin shipping eggs nationally and internationally rather than sending life specimens.
