The Issue

In South Africa, the National Register for Sex Offenders (NRSO) remains confidential and is primarily kept for internal vetting by employers in specific sectors, such as schools, crèches, and hospitals. Although the Ministry of Justice and Constitutional Development has recently announced plans to open it up, the register is still not accessible to the general public due to legislative barriers concerning privacy laws. This lack of public access is deeply concerning, especially since a significant number of perpetrators are repeat offenders.

As a society, we cannot allow our communities, especially our children, to remain vulnerable to such individuals. Transparency regarding individuals convicted of sexual offenses, femicide and other acts of GBV should be a priority. Knowing who these individuals are helps parents, guardians, and the wider community make informed decisions to protect themselves and their loved ones.

The current confidentiality of the NRSO does a disservice to those it should protect. While confidentiality is crucial for various reasons, the safety and wellbeing of the public should take precedence. When repeat offenders can continue their harmful behaviors undetected, it places everyone at risk. In recent years, there have been too many cases where individuals reoffend because communities were unaware of their past offenses.

Providing public access to the NRSO, as well as including the offenses of those who have committed femicide, pedicide (the killing of a child), and any other acts of GBV would serve as a significant deterrent. Offenders would be aware that their actions are publicly recorded, potentially decreasing the likelihood of reoffense. Furthermore, this transparency empowers the community to take proactive steps in safeguarding their environments.

By signing this petition, you urge the South African Parliament and the Ministry of Justice and Constitutional Development to prioritize legislation that grants public access to the National Register for Sex Offenders. Let us come together to ensure the safety of our children and community by advocating for access to crucial information that can prevent further victimization. Your voice is powerful, please sign this petition to make change happen.
