Amend the Land Use Bylaw to reflect the intent of the Provincial Model Land Use Bylaw to view Home Occupations as an Accessory Use of a Dwelling.

The Issue

We, the citizens of The Town of Lunenburg and its outlying areas wish to amend the wording of our Land Use Bylaw, so that it clearly reflects the intent of The Provincial Model Land Use Bylaw to ensure that Home Occupations,  a.k.a Home Based Businesses, are seen and function as Accessory Uses of a residential dwelling.  We want to form a committee of citizens and councilors and to use community consultation to write this necessary amendment, using the Provincial Model Land Use Bylaw as our guide.  The wording and associated definitions of the Bylaw must clarify that these uses are and can only be understood to be residential uses.   We want this amendment to be done in conjunction with the amendments to the Parking Regulations for Home Based Businesses. 

Without these necessary clarifications to our current Land Use Bylaw, it is possible for our current council and future councils to misunderstand the intention of the Provincial Model Land Use Bylaw and to mistake these permitted uses as being commercial uses.

Currently, these uses are being seen in the Town of Lunenburg as Commercial Uses.  The expense of the changes to the home in order to comply with the Building Official's Requirements are prohibitively expensive and force most small home based businesses to operate in non-compliance or to leave town.  New commercial uses in the residential zones of Lunenburg are contrary to the intent of our Municipal Planning Strategy.  Small, low impact, micro businesses are an important part of Lunenburg's economy.  Bringing these businesses into compliance works in everyone's best interests.  It promotes tourism, promotes other businesses and attracts new residents.
