This is the reply from the Romanian government and I am to say the least heartbroken. We all tried our very hardest to help the poor and innocent dogs but it appears to be to no avail sadly.

As a result of your notification, registered with the National Authority for Veterinary and Food Safety with no. 5209 / 05.03.2020, regarding a number of issues regarding the problem of dogs without a master in Romania, we inform you the answer prepared in your attention by the Directorate General for Official Control:
"The most recent changes of the regulations specific to the management program of the dog population without owner came in 2013 when, the Parliament of Romania introduced by Law no. 258 amendments concerning: the obligation to identify dogs with a master, the obligation to sterilize dogs with or without a master belonging to the common breed and their herds, as well as a series of amendments to articles providing for the possibility of euthanizing dogs without a master, captured and housed. Subsequently, based on the provisions of this law, two other normative acts were issued - Government Decision no. 1059/2013 for the approval of the methodological norms for the application of the dog management program without the owner and Order no. 1/2014 for approving the norms regarding the identification and registration of dogs with a master.
The purpose of the documents issued in this matter, taking into account all the aspects that were regulated at that time, was to reduce the number of dogs without a master, to improve the health and well-being of the dogs in shelters, to stop the uncontrolled breeding of dogs of common breed, to prevent the abandonment and loss. dogs, facilitating recovery of lost dogs, promoting responsible dog ownership, reducing the occurrence of rabies, preventing aggression on humans and animals. Through the modifications made to the management program of the dog without a master, the identification and registration of the dogs with the master, the sterilization of the dogs, including the dogs of the dog were promoted.
Through the modifications made to the dog management program, the identification and registration of stray dogs, sterilization of dogs, including dogs of common breed with owner, promotion, adoption, distance adoption, euthanasia was not one of the priority solutions of these norms.
At the same time, being aware of the fact that, only by taking into account several key elements, among which we mention: education, reproduction control, identification and registration, sterilization, vaccination, effective implementation of legal provisions, a management program can be developed. to the successful canine population, the National Veterinary Health and Food Safety Authority supports and promotes both awareness and education programs on responsible dog ownership, as well as population information activities on a multitude of materials of public interest. Regarding the organization of some campaigns regarding the sterilization of animals, we inform you about the existence of the website www.registru-caini.ro managed by ANSVSA, where numerous free sterilization campaigns of pets with and without owner from all over the country are posted, in addition to a number of other information designed to increase the transparency of activities carried out at the level of public / private shelters.
Through the actions that the National Veterinary and Food Safety Authority undertakes, it is intended that euthanasia - part of the dog management program without a master - will be applied only in cases where there are no other solutions, with the role of ending the suffering of some. animals that suffer from incurable diseases, behavioral problems that do not allow for the adoption, or animals that may suffer in the future, with very small chances that they will lead a decent life. At the same time, knowing that the actions of capturing, housing, sheltering dogs without a master in shelters / relocation centers cannot be used as the sole solution for the control of the canine population, we will continue to make efforts aimed at improving the programs for managing the dog population. without master, by increasing the application, simultaneously and continuously, of the other key elements previously mentioned (education, control of reproduction, identification and registration, effective implementation of legal provisions).
Since the achievement of this desire cannot be immediate, requiring long-term resources (financial, human, infrastructure), at this time we are still in a position to register euthanasia actions, sometimes as a consequence of the number, still relatively small by adopters, which can ensure and provide a good level of welfare to animals taken from shelters.
On the other hand, Law no. 258/2013 amending and supplementing O.U.G. no. 155/2001 regarding the approval of the management program for dogs without a master provided for both the obligation of the owners or owners of dogs, natural persons or legal persons, to identify the dogs held by microchipping or other means of identification established by the National Veterinary Health Authority and for Food safety, as well as details regarding the registration obligations in the Register of dogs with owner and the obligation to bear the costs of identification by the owners.
Regarding the costs related to identification, Order no. 1/2014 stipulates the following: "the dog owners have the obligation to pay the costs related to the identification and registration in the RECS, of the services provided by the veterinary medical assistance units or the university veterinary clinics", while leaving the possibility for the Local Councils to purchase microchips. This provision thus leaves the opportunity for initiatives by local public administration authorities or NGOs to carry out actions to subsidize the costs of microchips, as practiced in the case of sterilization actions, especially since the European Court of Human Rights. stressed that this problem, the management of dogs without a master, is not only the central or local public authorities, but also the civil society, which implies the effective involvement of associations and other types of organizations that have as their object activity protection of animals, including material and not only declarative.
At the same time, A.N.S.V.S.A. supports from the allocated budget the veterinary actions of national interest, according to the provisions of Order A.N.S.V.S.A. no. 35/2016 for the approval of the Methodological Norms for the implementation of the Strategic Program, with the subsequent amendments, from which we cite “rabies vaccination of dogs and cats over 3 months old is carried out in the campaign, once a year, between October and February, but no later than one year after the last vaccination, "and" the costs of rabies vaccination of dogs during the October - February campaign and during the complement vaccinations are fully borne by the state budget. "
During the years 2018-2019, ANSVSA also asked the Court of Accounts of Romania for a point of view, in support of the steps started in 2016 to inform the prefect's institutions and the local councils about the possibility of being actively involved in the identification and sterilization campaigns of dogs within the range of territorial administrative unit. Thus, the latest address sent by A.N.S.V.S.A. structures subordinated territories requested the notification, as soon as possible, both of the Prefect Institution and of the Local Councils from the county area, about their possibility of being involved in the campaigns aimed at identifying dogs with a breeder, specifying that, by encouraging such dogs practices, in the medium and long term, and based on interinstitutional collaborations, can record the efficiency of the other expenses regarding the management of dogs without a master, attributed exclusively to the territorial administrative units ".
In conclusion, A.N.S.V.S.A. They express their interest in the proposals received from associations and organizations that have as their object of activity the protection of animals, regarding the problem of managing dogs with and without a master, provided they are done in compliance with the law. We mention that all the costs of rabies vaccination are fully borne by the state budget and that during the last years several steps have been taken to find viable solutions regarding the identification and sterilization of dogs. Therefore, we expect from the interested parties real, concrete proposals, with material support, for carrying out identification and sterilization campaigns throughout the country and we assure you of all our availability regarding the engagement of the other decision-makers in order to do this possible. "

„Cele mai recente modificări ale reglementărilor specifice programului de gestionare a populației de câini fără stăpân au intervenit în anul 2013 când, Parlamentul României a adus prin Legea nr. 258 amendamente referitoare la: obligativitatea identificării câinilor cu stăpân, obligativitatea sterilizării câinilor cu sau fără stăpân aparținând rasei comune și metișii acestora, cât și o serie de amendamente asupra articolelor care prevăd posibilitatea eutanasierii câinilor fără stăpân, capturați și cazați în adăposturi. Ulterior, în baza prevederilor acestei legi au fost emise alte două acte normative - Hotărârea de Guvern nr. 1059/2013 pentru aprobarea normelor metodologice de aplicare a programului de gestionare a câinilor fără stăpân și Ordinul nr. 1/2014 pentru aprobarea normelor privind identificarea și înregistrarea câinilor cu stăpân.
Scopul actelor emise în materie, luând în considerare toate aspectele care au fost reglementate la acel moment, l-a constituit reducerea numărului de câini fără stăpân, ameliorarea sănătății și bunăstării câinilor din adăposturi, stoparea înmulțirii necontrolate a câinilor de rasă comună, prevenirea abandonului și a pierderii câinilor, facilitarea recuperării câinilor pierduți, promovarea deținerii responsabile a câinilor, reducerea apariției rabiei, prevenirea agresivității asupra oamenilor și animalelor.
Prin modificările aduse programului de gestionare a câinilor fără stăpân s-au promovat identificarea și înregistrarea câinilor cu stăpân, sterilizarea câinilor, inclusiv a câinilor de rasă comună cu stăpân, adopția, adopția la distanță, eutanasierea nefiind una dintre soluțiile prioritare ale acestor norme.
Totodată, conștientizând faptul că, numai prin luarea în considerare a mai multor elemente cheie, printre care menționăm: educația, controlul reproducerii, identificarea și înregistrarea, sterilizarea, vaccinarea, implementarea eficientă a prevederilor legale, se poate pune la punct un program de gestionare a populației canine care să aibă succes, Autoritatea Națională Sanitară Veterinară și pentru Siguranța Alimentelor susține și promovează atât programe de conștientizare și educare privind deținerea responsabilă a câinilor, cât și activități de informare a populației privind o multitudine de materiale de interes public. În ceea ce privește organizarea unor campanii privind sterilizarea animalelor, vă informăm despre existența site-ului www.registru-caini.ro gestionat de A.N.S.V.S.A, unde sunt postate numeroase campanii de sterilizare gratuite ale animalelor de companie cu și fără stăpân din întreaga țară, pe lângă o serie de alte informații menite să crească transparența activităților desfășurate la nivelul adăposturilor publice/private.
Prin acțiunile pe care Autoritatea Națională Sanitară Veterinară și pentru Siguranța Alimentelor le întreprinde se urmărește ca eutanasia - parte a programului de gestionare a câinilor fără stăpân - să fie aplicată numai în cazurile în care nu mai există alte soluții, cu rolul de a curma suferința unor animale care suferă de boli incurabile, probleme comportamentale care nu permit încredințarea spre adopție sau a animalelor care pot suferi și pe viitor, existând șanse foarte mici ca acestea să ducă o viață decentă. Totodată, cunoscând faptul că, acțiunile de capturare, cazare, adăpostire a câinilor fără stăpân în adăposturi/centre pentru relocare nu pot fi folosite ca unică soluție pentru controlul populației canine, vom continua să depunem eforturi menite să îmbunătățească programele de gestionare a populației de câini fără stăpân, prin creșterea aplicării, concomitent și continuu, a celorlalte elemente cheie anterior precizate (educație, controlul reproducerii, identificarea și înregistrarea, implementarea eficientă a prevederilor legale).
Întrucât atingerea acestui deziderat nu poate fi imediată, necesitând și alocarea de resurse (financiare, umane, de infrastructură) pe termen lung, la acest moment ne aflăm încă în situația de a înregistra acțiuni de eutanasie, uneori și ca o consecință a numărului, încă relativ redus de doptatori, care să poată asigura și oferi un bun nivel de bunăstare animalelor preluate din adăposturi.
Pe de altă parte, Legea nr. 258/2013 pentru modificarea și completarea O.U.G. nr. 155/2001 privind aprobarea programului de gestionare a câinilor fără stăpân a prevăzut atât obligația proprietarilor sau deținătorilor de câini, persoane fizice sau persoane juridice, de a identifica câinii deținuți prin microcipare sau prin alt mijloc de identificare stabilit de către Autoritatea Națională Sanitară Veterinară și pentru Siguranța Alimentelor, cât și precizări referitoare la obligațiile de înregistrare în Registrul de evidență a câinilor cu stăpân și obligativitatea suportării costurilor de identificare de către aparținători.
În privința costurilor legate de identificare, Ordinul nr. 1/2014 prevede următoarele: „proprietarii câinilor au obligația să achite contravaloarea costurilor legate de identificarea și înregistrarea în R.E.C.S, a serviciilor prestate de către unitățile medicale veterinare de asistență sau de clinicile veterinare universitare", lăsând totodată posibilitatea Consiliilor Locale de a achiziționa microcipuri. Această prevedere lasă astfel oportunitatea unor inițiative ale autorităților administrației publice locale sau ale unor ONG-uri, în desfășurarea unor acțiuni de subvenționare a costurilor microcipurilor, așa cum se practică în cazul acțiunilor de sterilizare, cu atât mai mult cu cât Curtea Europeană a Drepturilor Omului a subliniat faptul că, această problematică, a gestionării câinilor fără stăpân, nu ține numai de autoritățile publice centrale sau locale, ci și de societatea civilă, ceea ce presupune implicarea efectivă a asociațiilor și a altor tipuri de organizații ce au ca obiect de activitate protecția animalelor, inclusiv de ordin material și nu numai la nivel declarativ.
Totodată, A.N.S.V.S.A. susține din bugetul alocat acțiunile sanitar veterinare de interes național, potrivit prevederilor Ordinului A.N.S.V.S.A. nr. 35/2016 pentru aprobarea Normelor metodologice de aplicare a Programului strategic, cu amendamentele ulterioare, din care cităm ”vaccinarea antirabică a câinilor și pisicilor în vârstă de peste 3 luni se realizează în campanie, o dată pe an, în perioada octombrie-februarie, dar nu mai târziu de un an de la ultima vaccinare", iar ”costurile vaccinării antirabice a câinilor din timpul campaniei din octombrie - februarie și din timpul vaccinărilor de completare sunt suportate integral de la bugetul de stat".
Pe parcursul anilor 2018-2019, A.N.S.V.S.A a solicitat inclusiv Curții de Conturi a României un punct de vedere, în susținerea demersurilor începute în anul 2016 de a informa instituțiile prefectului și consiliile locale asupra posibilității de a se implica activ în campanii de identificare si sterilizare a câinilor de pe raza unității administrativ teritoriale. Astfel, cea mai recentă adresă transmisă de A.N.S.V.S.A. structurilor teritoriale subordonate solicita notificarea, în cel mai scurt timp posibil, atât a Instituției Prefectului, cât și a Consiliilor Locale de pe raza județelor, despre posibilitatea acestora de a se implica în campaniile destinate identificării câinilor cu aparținător, precizând că, prin încurajarea unor astfel de practici, pe termen mediu și lung, și în baza unor colaborări interinstituționale, se poate înregistra o eficientizare a celorlalte cheltuieli privind gestionarea câinilor fără stăpân, atribuite exclusiv în sarcina unităților administrativ teritoriale".
Concluzionând, A.N.S.V.S.A. își manifestă tot interesul pentru propunerile venite din partea asociațiilor și a organizațiilor ce au ca obiect de activitate protecția animalelor, referitoare la problematica gestionării câinilor cu și fără stăpân, cu condiția ca acestea să se facă cu respectarea legii. Menționăm faptul că toate costurile vaccinării antirabice sunt suportate integral de la bugetul de stat și faptul că în decursul ultimilor ani s-au făcut mai multe demersuri pentru găsirea unor soluții viabile în ceea ce privește identificarea și sterilizarea câinilor. Prin urmare, așteptăm din partea celor interesați propuneri reale, concrete, cu susținere materială, pentru realizarea unor campanii de identificare și sterilizare pe întreg teritoriul țării și vă asigurăm de întreaga noastră disponibilitate în ceea ce privește angrenarea celorlalți factori decizionali pentru a putea face acest deziderat posibil. ”
