A petition has been filed stating that section 375 of the Indian Penal code is discriminatory and shall be made gender-neutral.

The criminal justice society of India has filed this petition saying the provision should be declared violative of right to equality and the right to personal liberty given under the constitution of India.

It has stated that the transgenders including but not limited to homosexuals and bisexuals, and men have not been considered to be a victim of rape under the existing penal laws of the country. It has further says that society is growing and we must develop empathy for all victims of rape including male and transgenders.

It has said that lack of penal provision of male and transgender rape has affected the ability of the victims to recognize their own victimization.

Petition also stated that the Law Commission in its 172nd report to amend the rape laws while making it gender neutral. It further says how often the cases of male rape victims are ignored in India and the psychological hesitation among men to report such cases.
