RIT, NGO has filed the Petition before the Hon'ble High Court of Delhi, demanding the criminalization of marital rape law. The Hon'ble Court may allow or dismiss the Petition. Govt of India, like 377 IPC, may file the appeal if the order would have gone against existing provisions. we have supported the Govt of India, by sending this petition with signatures, which was sent to the Law Commission, comments reproduced as follows:
"Sir/Madam ,
Please refer to your email dated 18-12-2015 on the subject opposing criminalisation of "Marital rape law" in the Indian Penal Code . In this regard, it is stated that the 21st Law Commission of India has been constituted but Hon'ble Chairman and Members are yet to be appointed. However, a project titled "Comprehensive Review of Criminal Justice System" is pending for the consideration of the Commission. Therefore, your representation has been kept in the concerned file for further necessary action, if any. ------ Law Commission of India."

So, if any reverse happens, we, may, with the signatures of the affected individuals, file the Interlocutory application for intervention before the Supreme Court of India, so that innocent husbands, like 498A, DV, may not be harassed for settlement of money or vengeance whatsoever
