Advocating on marital rape law by saying” My body my rights” philosophy is just an eye wash..They want that husband to be punish on their allegations…reality is that 498-A becomes ineffective to major extent after Hon’ble Supreme court of India Judgment in Arnesh Kumar Versus State Of bihar” as there will not be routine arrests in offences where punishment is less than 7 years …Still rape law is best weapon can be used against the husband and in laws to extort money from their family as the case will tried by the court of session and her statement before magistrate made under 164 crpc is sufficient to put husband in jail where he could be languished in jail for several months/years before the completion of trial Many 498-A husbands has grievances that their wife have extramarital relations, filed the 498-A/DV cases just to harass them. Clearly shows such wife donot want to give divorce and enjoys the marriage tag at the expense of the husbands It has clearly seen that in all Domestic Violence cases the women has been asked to fill the format through protection officer, where she routinely made allegations of having forced “relationship” by their husbands and if marital rape law is passed then all DV cases will be converted into “MARITAL RAPE” cases.The hon’ble supreme court has already made deep concern in the aforesaid judgment about the over flooded cases of 498-A across the country and already predicted abou their acquittal( it could be 4 Lakhs) Of course, cruelty caused by man and woman needs to be condemned. There are ample provisions are there in Mrraiage Law to opt for Divorce if any spouse commits cruelty..But using maraital rape law against husband where the wife is always be the victim and husband is the offender is nothing but another STUPID BIASED LAW which will surely be used as another weapon aginst the innocents..Men Rights Associations across the country should raise their voice to show their solidarity against the biased laws
